Certification of <br />publication and notice of public hearing were <br />established. <br />Mayor Fauson opened the public hearing. <br />Mayor Fauson asked for any public comments either <br />in favor of or in opposition to this Ordinance. <br />None. <br />Mayor Fauson closed the public hearing and called <br />for a motion. <br />Carnival moved to adopt Ordinance #1028, Series <br />1990, seconded by Hornbostel. By Roll Call Vote, <br />Ordinance #1028, Series 1990 was adopted 5-0. <br />ORDINANCE #1031, SERIES 1990 - VACATING ALLEY RIGHT-OF-WAY - <br />NORMAN ELMS - 2ND READING - PUBLIC HEARING. <br />Griffiths read by title only, Ordinance #1031, "An <br />Ordinance vacating a portion of an alley located <br />in Corrigan Addition." Certification and notice <br />of public hearing were established. <br />Mayor Fauson opened the public hearing. <br />Franklin: Norman Elms has requested that the city vacate a <br />20 foot wide alley right-of-way located south of <br />his property. The right-of-way is used for city <br />utilities and an easement must be retained. <br />Boulder Valley School District has also requested <br />that the city retain a pedestrian easement from <br />the end of Johnson Avenue to the Louisville <br />Elementary School grounds. This Ordinance was <br />amended to incorporate language that the City <br />Attorney provided. <br />Mayor Fauson asked for any public comments either <br />in favor of or in opposition to this Ordinance. <br />None. <br />Griffiths: The amendment added a new Section 2 which <br />specifically addressed the rights-of-way and the <br />easements. This did not appear at First Reading, <br />but you may approve this on Second Reading as <br />amended.
