Franklin: No, there has not been. Mayor Fauson called for a motion. Carnival moved tO adopt Resolution No. 32, Series 1990 as submitted, seconded by Hornbostel. By Roll Call Vote Motion Passed 7-0. DISCUSSION/DIRECTION - LICENSE AGREEMENT WITH BOULDER VALLEY SCHOOL DISTRICT - USE OF OLD VIA APPIA RIGHT-OF-WAY Franklin: The Boulder Valley School District requests approval of a License Agreement which would allow use of the old Via Appia street right- of-way for parking and landscaping improve- ments related to Fireseide Elementary School. The School District has installed sidewalk and landscaping improvement and will not seek any reimbursement for this; the parking lot expansion area is yet to be paved. I would ask Council to approve the agreement with the minor changes suggested by the attorney. Grittiths: There are additions to the agreement that should be added. The first amendment de- scribed is to add a new paragraph C to para- graph seven. All other corrections are wording corrections. Don Shonkwiler, representing Homart Development. Shonkwiler: Asked if the License Agreement would only allow the School District and the City to have access to the old Via Appia. I would like to see in the agreement, if required, storm sewer and sanitary sewer outfall through this licensed territory if we need to access the stubs to the storm sewer and sanitary sewer lines. Asked if this could be looked into. Carnival moved to approve the License Agreement with the Boulder Valley School District with the corrections that the attorney has presented, seconded by Davidson. Motion Passed OTHER REGULAR BUSINESS ITEMS ARISING AFTER PREPARATION OF AGENDA Mayor Fauson: Received a phone call from Homer Page regard- ing the Transportation Coalition. The Coali- tion did meet, they did send the minutes of that meeting and the Coalition did agree that they would like to pursue the Airport Access.
