Hornbostel: At one point a number of residential permits were <br />tied to commercial permits, is that still in the <br />agreement? <br />Brand: Said Griffiths & Tanoue would look into it. <br />Howard: I would like to get a firm view of the water <br />issues involved in all the trades. Also I do not <br />understand why the last paragraph was tacked onto <br />this amendment. I also would like to get a firm <br />understanding of what Mr. Biella's issue is. <br />Phare: Four or five months ago we discussed an overall <br />agreement with Homart and at the same time we had <br />a couple of exhibits as to what happened. <br />Brand: Felt that the wrong description was used in the <br />parcels that were conveyed and where the zoning <br />comes in, is that Homart will have to give up some <br />portion of its open space to satisfy the commit- <br />ments that were made to Mr. Biella at the time <br />when the description was wrong. The open space <br />will have to be zoned commercial. <br />Howard: Wanted to know exactly what the property looks <br />like, exactly what we are doing and why we are <br />doing it, before voting on any rezoning. I do not <br />have any understanding of the issue. <br />Brand: Request for Rezoning will come back through regu- <br />lar process with Planning Commission. <br />Mayor Fauson: I had requested the inventory of this issue some <br />years ago. I requested the inventory so Council <br />could make judgment on what we could do and not do <br />with other developers. If it did affect the <br />inventory on prepaid taps. I would like Council <br />to have an in-depth view of exactly what is owed <br />to us and what we owe. Where we stand and when we <br />do make a decision we know exactly where we are at <br />and why we are doing it. <br />Howard: Was concerned with an open ended charter. Would <br />like to see some type of limit. <br />Griffiths: If it would be possible to have Scott Ross get <br />started on this matter, I think it would be bene- <br />ficial. I will be able to report to you at the <br />next Council meeting where we are with it and how <br />much time we have spent, and how much more time we <br />will need to spend on this. The other thing we <br />can do is to provide you something in writing when <br />we have had a chance to look at it. <br />Sackett: Felt this was something that needs to be done. In <br />6 <br />
