Hornbostel: At one point a number of residential permits were
tied to commercial permits, is that still in the
agreement?
Brand: Said Griffiths & Tanoue would look into it.
Howard: I would like to get a firm view of the water
issues involved in all the trades. Also I do not
understand why the last paragraph was tacked onto
this amendment. I also would like to get a firm
understanding of what Mr. Biella's issue is.
Phare: Four or five months ago we discussed an overall
agreement with Homart and at the same time we had
a couple of exhibits as to what happened.
Brand: Felt that the wrong description was used in the
parcels that were conveyed and where the zoning
comes in, is that Homart will have to give up some
portion of its open space to satisfy the commit-
ments that were made to Mr. Biella at the time
when the description was wrong. The open space
will have to be zoned commercial.
Howard: Wanted to know exactly what the property looks
like, exactly what we are doing and why we are
doing it, before voting on any rezoning. I do not
have any understanding of the issue.
Brand: Request for Rezoning will come back through regu-
lar process with Planning Commission.
Mayor Fauson: I had requested the inventory of this issue some
years ago. I requested the inventory so Council
could make judgment on what we could do and not do
with other developers. If it did affect the
inventory on prepaid taps. I would like Council
to have an in-depth view of exactly what is owed
to us and what we owe. Where we stand and when we
do make a decision we know exactly where we are at
and why we are doing it.
Howard: Was concerned with an open ended charter. Would
like to see some type of limit.
Griffiths: If it would be possible to have Scott Ross get
started on this matter, I think it would be bene-
ficial. I will be able to report to you at the
next Council meeting where we are with it and how
much time we have spent, and how much more time we
will need to spend on this. The other thing we
can do is to provide you something in writing when
we have had a chance to look at it.
Sackett: Felt this was something that needs to be done. In
6
