I would like to know <br />what fund this will come out of. <br />Asti-Caranci: There are only a couple of days left in this year <br />and a new budget is going to start. I would <br />assume you would have to do something out of the <br />1991 Council Contingency Fund or you may want to <br />split it between funds because it does relate to <br />water, sewer and general fund. <br />Davidson: I would like the staff to come back and make a <br />recommendation as to what fund this will come out <br />of. <br />Sackett moved to authorize staff to employ our City Attorneys to <br />do inventory and analysis of the agreement between Centennial <br />Valley and the City of Louisville and to authorize at least 40 <br />hours to get started on this issue, seconded by Howard. All in <br />favor. Motion passed. <br />AUTHORIZATION TO REFUND SPECIAL GUARANTY FEES TO INDIVIDUAL <br />HOMEBUILDERS, PONDEROSA SUBDIVISION <br />Brand: We have been discussing this subdivision for <br />several meetings. In the process of trying to <br />find enough money for the public improvements, a <br />former Community Development Director assessed a <br />special guaranty fee of $1,613 on each building <br />permit to developers. In the process there were <br />five homeowners who had contracted to build their <br />own homes. They were the ones who paid the $1,613. <br />These homeowners pointed out that they have paid <br />this fee and they would like to have the city <br />refund this to them. I have discussed this matter <br />with the City Attorney and she agrees that we <br />should refund the $1,613 to those homeowners who <br />paid the fee, upon written request from the home- <br />owners. <br />Howard: Does the city have proof that the fee has been <br />paid by the homeowners? <br />Brand: Yes the city has the proof that these homeowners <br />did pay the fee, but we have not gotten written <br />requests from them yet. <br />Sackett: Did not understand why we would pay back the money <br />to just these homeowners. <br />7 <br />
