Levihn moved that Council adopt Ordinance No. 1197, Series 1995, on second and final reading with <br />amendments. Seconded by Howard. Roll call was taken. Motion passed by a 6 - 0 vote with Sisk <br />being absent. <br /> <br />INTERIM FINANCIAL REPORT - THROUGH JULY 31, 1995 <br /> <br />Dianne Ray, Finance Director, presented the interim financial report. <br /> <br />Mayer reminded Council that he had stated last year that the City's estimate for building permits this <br />year was too high, which they were. He felt the preliminary number being used for next year is too <br />high and he wanted that looked into. <br /> <br />Lathrop stated that they wanted to look into having contractual services be split out as a line item. <br /> <br />STERLING ANNEXATION (HOME DEPOT) <br /> <br />RESOLUTION NO. 42, SERIES 1995 - OF THE CITY COUNCIL OF THE <br />CITY OF LOUISVILLE, COLORADO, FINDING SUBSTANTIAL <br />COMPLIANCE OF A PETITION FOR ANNEXATION OF CERTAIN <br />PROPERTY FILED BY BELLOCK CONSTRUCTION COMPANIES <br />KNOWN AS STERLING HEIGHTS, THE SETTING OF A PUBLIC <br />HEARING THEREON <br /> <br />Peter Kernkamp, Planner, stated that No. 1 was a resolution on substantial compliance, No. 2 is an <br />ordinance annexing property to the City of Louisville on first reading and setting a public hearing, and <br />No. 3 is an ordinance establishing, upon annexation, Commercial Business zoning on the property. <br />He pointed out that there was a correction to be made on Resolution No. 42, Section 4, the date for <br />the public hearing should be October 3, 1995. He explained that this annexation involved some <br />existing right-of-way that was platted as part of the Sterling Heights Subdivision located in <br />unincorporated Boulder County immediately adjacent to the proposed Home Depot site. The County <br />Commissioners had signed the petition for annexation. Upon annexation the City would vacate the <br />right-of-way. Bellock Construction had made arrangements with the adjoining property owner to <br />whom that vacated right-of-way would go to, to acquire that property and incorporate it into the <br />Home Depot site. Most of the vacated fight-of-way would be developed as a landscaped buffer <br />between the proposed Home Depot and the existing residential development to the west. He stated <br />that the City had received the Final Plat and PUD for Home Depot and it had passed on a preliminary <br />basis from Planning Commission. It will be going back to Planning Commission on September 12 <br />and will come to Council on October 3, 1995, along with the annexation. <br /> <br />Davidson called for applicant's presentation. <br /> <br />Applicant not present. <br /> <br /> <br />
