Anderson stated he would abstain from discussion and any action on the <br />next two Agenda Items due to possible conflict of interest. <br />ORDINANCE #986, SERIES 1989 - POW WOW GROUNDS REZONING - 2ND READING - <br />SET PUBLIC HEARING Read by title only, Ordinance #986, Series 1989, <br />"An Ordinance amending Title 17 of the Louisville <br />Municipal Code entitled "Zoning" by rezoning <br />property owned by Herman Schempp known as the Pow <br />Wow Grounds." Proof of publication and notice of <br />public hearing were established. <br />Mayor Fauson opened the public hearing. <br />Franklin stated that the owner, Herman Schempp, <br />has requested approval of a rezoning of the 45+ <br />acre Pow Wow Grounds from A-Agriculture to PCZD <br />Planned Community Zone District. The owner has <br />submitted a General Development Plan, which will <br />be the item for Council to consider if this <br />Ordinance is adopted. The proposed uses are <br />commercial/office and residential. Planning <br />Commission reviewed this request and recommends <br />approval. <br />Mayor Fauson asked for any public comments either <br />in favor of or in opposition to Ordinance #986, <br />Series 1989. None. <br />Mayor Fauson closed the public hearing and called <br />for a motion. <br />Mohr moved and Scarpella seconded to adopt <br />Ordinance #986, Series 1989. <br />Sackett asked that the presentation regarding the <br />General Development Plan take place now so that <br />they fully understand the impact of approving this <br />Ordinance. <br />Mohr and Scarpella both agreed to withdraw their motion to adopt the <br />Ordinance until after the presentation. <br />Jennifer Rodriguez, Rocky Mountain Consultants, <br />representing the applicant Herman Schempp, <br />presented the plan outlining the uses and layout <br />of the project stating that the owner Herman <br />Schempp, Schempp Park LTD., has requested approval <br />of a General Development Plan for the property and <br />rezone it to PCZD. The proposed uses shown on the <br />Schempp General Development Plan are Residential <br />and Commercial/Office. Public use land dedication <br />includes open space buffer, "gateway" area at <br />South Boulder Road, lake-oriented open space and <br />Hecla Lake property. There would be approximately <br />70 residential units (6 units per acre). <br />4 <br />
