SIMMONS, CITY MANAGER <br />DATE: September 20, 2005 <br />SUBJECT: Resolution No. 38, Series 2005, a resolution proposing regulations for the <br />phasing of new residential development <br />ORIGINATING DEPARTMENT: Planning <br />STAFF SUMMARY /COMMENTS: <br />The Implementation chapter (Chapter 4) of the Citywide Comprehensive Plan Update, adopted on <br />August 16, 2005, discusses the importance of controlling the pace at which residential development <br />occurs in Louisville. There is a specific directive in the Plan to implement a residential phasing policy. <br />The attached resolution is an effort to create such a residential phasing policy for the City. <br />A preliminary draft of the Resolution was reviewed by City Council as a discussion /direction item at <br />the September 6, 2005 City Council meeting. Based on the preliminary direction received by Staff, the <br />attached draft is prepared for City Council review and action. Revisions have been made based on <br />Council direction on September 6. Due to the scope of revisions and a change in formatting, a "redline" <br />version was not prepared. <br />Portions of the Resolution closely parallel Resolution No. 36, Series 1993 (attached), which was the <br />residential growth control resolution approved by City Council in 1993. That resolution adopted certain <br />residential growth policies for annexations as well as establishing an annual goal for the number of new <br />residential building permits in each calendar year. <br />This new Residential Phasing Resolution is designed to manage; the City's pace of residential growth in <br />the coming years. The recitals in the Resolution are closely linked to principles and policies in the <br />recently adopted Citywide Comprehensive Plan. The importance of maintaining the City's fiscal health <br />and balance is an emphasis. <br />Section 1: This section contains the general criteria to be used by City Council in evaluating the impacts <br />of residential development applications. Criteria `A' through `I' are generally repeated from draft <br />reviewed on September 6. The criteria require projects to comply with the principles and policies of the <br />City's Comprehensive Plan and they require the fiscal impacts be closely evaluated. Criterion `A' <br />creates a requirement for all residential development applications to include a fiscal impact analysis. <br />Staff has discussed that this should also be added to the submittal requirements for development <br />applications as established in Chapters 16 and 17 of the LMC. That would be forwarded for City <br />Council review as an Ordinance Amendment at a later date. <br />City Council's ability to exempt certain projects (Criterion H) vas modified to be more general in its <br />SUBJECT Resolution No. 38, Series 2005 AGENDA ITEM <br />Residential Phasing <br />
