SUBJECT: Resolution No. 38, Series 2005, a resolution regulating the phasing of all new <br />residential development <br />DATE: September 20, 2005 <br />reference to Comprehensive Plan consistency. That criterion w,as also expanded to reference a potential <br />exemption for projects located within an Urban Renewal District. Criterion `I' was added. It provides <br />an exemption from the permit allocation process for residential lots created on subdivision plats <br />approved prior to October 1, 2005. This exemption is intended to allow the few residential lots that are <br />vacant in the Old Town area and on some smaller subdivisions throughout the City (i.e. Fischer Farms, <br />Bella Vista South, etc.) to be built upon without going through t:he annual allocation process. <br />Section 2: Section 2 establishes the maximum biannual allocation of 250 residential units, along with a <br />maximum of 150 units in any given calendar year. This section would be reviewed biannually in <br />conjunction with Council's review of the Comprehensive Plan. <br />Section 3: Section 3 established the residential allocation from October 1, 2005 through December 31, <br />2006 at a maximum of 150 units. This section would be reviewed annually to establish the goal for the <br />maximum number of residential permits for the following calendar year. <br />Section 4: Section 4 provides a general framework for the City Manager to create rules to administer the <br />residential phasing program. The rules would create a more specific framework for City Council to <br />prioritize the residential allocation, including a process whereby property owners /developers would <br />submit their requests for an allocation of permits. <br />Additional Staff Comments: Resolution No. 36, Series 1993 h.as places certain controls on residential <br />development, including residential annexations. City Council repealed the provisions of that Resolution <br />pertaining to an annual allocation of residential permits in 2000 (see attached Resolution No. 18, Series <br />2000). However, all other provisions of the resolution remain in place. With the adoption of the new <br />Comprehensive Plan and if an associated residential phasing resolution is adopted by City Council, staff <br />would recommend City Council consider the repeal of Resolution No. 36, Series 1993. Staff would <br />package that for City Council consideration at a subsequent meeting. <br />RECOMMENDATION: If City Councils desire to approve Resolution No. 38, Series 2005, a <br />resolution establishing Residential Phasing Regulations, ADOPT A MOTION APPROVING <br />RESOLUTION NO.38, SERIES 2005. <br />
