Allenbaugh stated that for 11 years she has been on the City of <br />Boulder Fire Department. She is a Lieutenant and has worked as an <br />emergency medical technician and as a fire fighter. She is not <br />unaware of the safety issues, but does not think it's a problem. <br />She stated that the place where bicycles have accidents is on the <br />streets, where cars cannot see bikes, where there is no control. <br />She commented that there is a private driveway across the Boulder <br />City Bike Path and there has never been a problem on that bike <br />path. If Council would look at it, it is one of the worst areas <br />for being able to see and there has never been a problem. She <br />stated, saying she would even sign something, saying that she will <br />not touch any of this land where the trees are. She loves open <br />space and wild areas, as much as the neighbors do. She will <br />landscape around her house on the upper area, which has now turned <br />into Canadian Thistle and the children do not play in that area. <br />The driveway was never a bike path. It was always a driveway. <br />There is a bike path access about five (5) houses down. She stated <br />that she is a single person, not a family, and she's gone 10 <br />days/month, because of her job. <br /> <br />Howard: <br /> <br />There is a proposal to connect this <br />bike trail with Cleo Mudrock Park. <br />Do you believe that this will have <br />no impact upon the trail usage, or <br />increase trail usage, or decrease <br />trail usage? <br /> <br />Wood: <br /> <br />I would assume it would increase the <br />trail usage. <br /> <br />Howard: <br /> <br />We have the rights of the property <br />owner to develop the property and we <br />have an indeterminate amount of <br />safety issues by the public. That's <br />really what we have to decide on, <br />the balance between those two. The <br />only alternative is, if that were <br />open space. The only way that I can <br />see, with the applicant unwilling to <br />sell it to us, would be some kind of <br />condemnation. I don't think I could <br />agree with the City doing that. I <br />can't see an equitable solution. <br /> <br />Sisk was very concerned about the safety issue and did not want to <br />end up in litigation. He felt that the City needed to buy the <br />property. <br /> <br />Mayer moved that Council acquire the property in question, eminent <br />domain, if necessary.
