representing the City in this
matter.

Sisk:

I would think that should be Annette
Brand and that would be part of my
motion.

Howard, seconder, accepted that. Roll call was taken. Motion
passed by a 5 - 2 vote with Lathrop and Hedding voting against.

~PROV~OFEMP~YMENTAG~EME~, OPPERMAN &~SOCIATES,
P.C.

Griffiths stated that the second issue was the acquisition of legal
assistance for the City in pursuing the acquisition and
condemnation, if necessary. There was a proposal before Council
from Opperman & Associates.

Sisk suggested that before Council signs an employment agreement,
they allow Annette Brand, City Administrator, to take steps to
reach Mrs. Allenbaugh or her representative to see if something
could be worked out. He felt that it would be
useful to look at the various costs on how they would be
apportioned, which might be useful in terms of the negotiations
with Mrs. Allenbaugh. He thought it would be an excellent idea, if
Sisk would chair the committee.

Sisk moved that the matter of an employment agreement be taken up
at a later date and that this matter be referred to the Mayor's
sub-committee, which Hornbostel, Hedding, and himself are members.
He felt that would be an appropriate committee, which holds
meetings in public to hear and solicit proposals from parties that

5
