with the City in terms of pursuing the acquisition and condemnation <br />process. <br /> <br />Davidson called for Council discussion. <br /> <br />Sisk spoke of the sensitive nature of this situation. He suggested <br />that before Council retains council, that~Council makes an endeavor <br />to go forward with the ordinance, but try to have Mrs. Allenbaugh <br />contacted concerning the purchase. He felt condemnation should be <br />looked at as a last resort. <br /> <br />Lathrop felt that the undertaking of this ordinance is just the <br />first step in the taking of a person's property for the so called <br />"public good." He stated that he would not support the ordinance <br />in any way. <br /> <br />Hedding was upset by this ordinance and the whole situation. <br />agreed with Lathrop completely. <br /> <br />He <br /> <br />Howard stated that condemnation should occur as a last resort. He <br />felt that the best possible way to resolve the issue would be to <br />acquire the property with the consent of the owner at a fair market <br />price. He did not believe that it is in the City's best interest <br />to allow the construction of a single family home on this <br />particular property. <br /> <br />Mayer stated that this piece of land made no sense in 1986 and it <br />makes no sense today, as far as being developed, feeling that it <br />would make useless any of the public open space to which access is <br />now granted. He would like to work something out with Mrs. <br />Allenbaugh before condemnation, but he felt Council had to "bite <br />the bullet" on this one. <br /> <br />Hornbostel felt that the real heart of this matter was the public's <br />safety. <br /> <br />Davidson did not favor condemnation, but he did feel it was <br />important, if nothing else could be worked out. <br /> <br />Sisk moved that Council approve Ordinance No. 1104, Series 1993, at <br />1st reading and set a Public Hearing for May 18, 1993, authorizing <br />acquisition of what is commonly referred to as the Allenbaugh <br />property. Seconded by Howard. <br /> <br />Griffiths: <br /> <br />There is a "blank" on page 2, <br />section 2 of the ordinance that <br />needs to be filled in. What is <br />needed is a position or a person who <br />would be authorized to negotiate for <br />the acquisition of the property on <br />behalf of the City. That ought not <br />to be any of the attorneys <br /> <br />4 <br /> <br /> <br />
