ORDINANCE NO. 1118, SERIES 1993 - SUBMITTING TO THE REGISTERED <br />ELECTORS OF THE CITY OF LOUISVILLE, COLORADO, AN ADVISORY QUESTION <br />OF WHETHER THE CITY COUNCIL SHOULD ADOPT A SCHOOL IMPACT FEE <br />APPLICABLE TO NEW RESIDENTIAL DWELLING UNITS IN THE CITY - 2ND <br />READING - PUBLIC HEARING (PUBL. LSVL. TIMES 8/4/93) <br /> <br />Griffiths read by title only Ordinance No. 1118, Series 1993, "An <br />ordinance submitting to the registered electors of the City of <br />Louisville, Colorado, an advisory question of whether the City <br />Council should adopt a school impact fee applicable to new <br />residential dwelling units in the city." <br /> <br />Susan Griffiths, City Attorney, stated that she had received a <br />telephone call yesterday from Jerry Kaplan, School District <br />Attorney. She explained that she had requested information on the <br />School Board's position on the school impact fee prior to this <br />Council meeting, because of the close time requirements of the <br />November election. Mr. Kaplan indicated that the School Board had <br />acted last Thursday evening and had decided not to include in any <br />bond question the receipt of impact fees as part of any required <br />funding for the School District. However, the Board encouraged <br />communities to continue the discussion of impact fees after the <br />November election. He also stated that they encouraged Louisville <br />to place the matter on the ballot in November, so that it could be <br />adopted after the election, if Louisville voters decided to approve <br />the measure. He stated that the Board is sensitive to and in some <br />part unhappy with respect to some of the conditions included in the <br />Louisville's proposed Ordinance No. 1118. She explained <br />concerning time deadlines that she has calculated that September 8 <br />is the 55th day prior to the November 2 election and is the last <br />day for the city to certify ballot questions to the County Clerk <br />for appearing on the November 2 ballot. There is a Council meeting <br />September 7, so action could be taken on that day. <br /> <br />Hornbostel stated that the items they didn't like were: <br /> <br />1.) Year around schools must not be imposed within <br /> Louisville, unless they are imposed District-wide at the <br /> same time. <br />2.) Louisville had said that the school impact fee must be <br /> phased in over a three to four year period, at no more <br /> than $1,500.00 per year. They wanted to try to have the <br /> fee all at once. <br />3.) They weren't happy with the fact that within a year of <br /> the effective date of Louisville's impact fee, Boulder <br /> County and all municipalities within the School District <br /> must impose a similar impact fee or develop and implement <br /> an alternate source. <br /> <br />Davidson opened the public hearing. <br /> <br />5 <br /> <br /> <br />
