Kyle Callahan, 220 South Jefferson, Louisville, Colorado, spoke in <br />favor of the school impact fees. He stated that one of the fees <br />that isn't charged is an impact fee to the school system, while <br />there are hook-up fees to the sewer and water, etc. He felt that, <br />if Louisville were to come to the table as more of a partner with <br />Boulder Valley School District, they would be more likely to be <br />more expedient to answer more of Louisville's problems concerning <br />overcrowding. He felt development should pay it's own way. <br /> <br />Pat Hornbostel, 655 West Hawthorn, Louisville, Colorado, stated <br />that when the houses around the golf course came in, he asked that <br />an impact fee be implemented. When Lafayette brought in Blue Heron <br />Estates, he asked Lafayette if they would implement an impact fee. <br />He stated that there are now houses in both places and they are not <br />the schools for them. Hornbostel stated that development had to <br />start paying its own way and now is the time to act. <br /> <br />Susan Morris, 939 West Maple Court, Louisville, <br />encouraged Council's support of the school impact fee. <br /> <br />Colorado, <br /> <br />Davidson called for anyone else in the audience wishing to speak in <br />favor or against Ordinance No. 1118. <br /> <br />NONE <br /> <br />Davidson closed the public hearing and called for Council comments. <br /> <br />Howard noticed on the proposed ordinance that there were no <br />provisions for escrowing any monies that are collected. <br /> <br />Griffiths stated that the ordinance itself does not impose a school <br />impact fee. It is an advisory question being presented to the <br />voters asking the voters of Louisville if they would support a <br />school impact fee subject to these conditions. If the vote is <br />"yes," the Council would not be obligated to impose a school impact <br />fee. Council would have to draft a specific ordinance imposing a <br />fee. <br /> <br />Howard: <br /> <br />Griffiths: <br /> <br />Would us going to the people <br />decrease their ability to win a suit <br />against the City of Louisville? <br /> <br />Likely not. The issues that they <br />have raised in that case are similar <br />to issues that might be raised with <br />respect to any Boulder Valley <br />entity, including Louisville. They <br />are not related to whether or not <br />there was voter approval of the <br />measure. <br /> <br /> <br />
