Gri. ffith suggested that they could just say that the closing of the
land trade shall occur on the dates agreed by the parties.

Davidson asked for any further Council discussions. None. He
asked for a Roll Call Vote. Yes: Davidson, Hornbostel, Howard,
Lathrop, Mayer and Hedding, 6/0, passed.

Davidson pointed out that State Senator, Paul Weissmann was in the
audience.

ORDINANCE NO. 1129, SERIES 1993 - VACATING A PORTION OF SOUTH 80TH
STreET BETWEEN DYER ROAD AND UNITED STATES HIGHWAY 36 WITHIN THE
CITY OF LOUISVILLE, COLORADO- 1STREADING - SET PUBLIC~RARING 11-
3-~3

Griffiths said an Ordinance vacating a portion of South $0th Street
between Dyer Road and United States Highway 36 within the City of
Louisville, Colorado.

Davidson said that Councilman Sisk asked, if this item could be
delayed until he could be at the meeting and suggested that it be
delayed until Councilman Sisk arrives. No objections. D and E
will both be delayed and go on to agenda Item F.

DIE:CUSSION/DIRECTION - TREEHAVEN PRELIMINARY SUBDIVISION Plat

Davidson asked the staff to present. Paul Wood indicated that the
applicant wasn't present and Davidson suggested delaying this item
also and moved on to Gl.

OT~R REGULAR BUSINESS ITEMS ARISING AFTER PREPARATION OF AGENDA
SE~ICE EXPANSION FEE AND TAP FEES

Davidson called upon Mayer.

Mayer as mentioned previously, he was going to bring up the
revision of tap and service expansion fees. Resolution 36, which
is our Growth Control Resolution, which we have given preliminary
ap~.roval, said that these would be reviewed annually and fees set
to make sure that growth covers it's own way. The most recent 12
months CPI in the Denver/Boulder area shows the price was up 4.3%.
Given these facts, I would ask Council to direct the City Attorney
to draft an ordinance that one, would increase the service
ex~.ansion fee by ten cents a square foot and this would be lightly
less than 4.3%; two, that the water tap be increased by 4% or $300
except on the Homart Property which would be increased by 3% as per
the Homart Agreement. What would happen is the City Attorney would
draft the Ordinance and it would be presented to Council on First
Reading at the next Council Meeting.

Davidson asked, if that was in the form of a motion.

9
