long-term plan on drainage in that area.
immediate?

Is there something more

Davidson replied that the water accumulates there, as it drains off
from higher ground and backs up and floods the area, overruns the
ditch, goes up into the farmers irrigation ditch and overruns in
there and runs down and eventually floods in front of the fire
house. We told the residents that we would get back to them what
thc: long-term drainage plans are and some idea, when the City would
be addressing those.

Hornbostel said that the residents felt there might be another arm
to the ditch, that is not in use and something that circulates
around and when that overflows, then, it floods into a certain part
of it. We will need to have you check into these things.

Phare indicated that he tried to make contact with the property
owner, who was on the sign-up sheet, but hasn't received a response
back.

Hornbostel said it is something that we need to look into it and we
need their information to make a good decision.

Ho~'ard made a motion that the Council i~approve Ordinance 1125,
Series 1993, an ordinance to vacation Harper Street right-of-way on
first reading and a public hearing for November 3, 1993.

Gri~ffiths reminded them about the additional on the land execution
agreement.

Seconded by Hornbostel. Davidson asked for further Council
dis. cussion. None. He then called for a Roll Call Vote. Yes:
He6.ding, Mayer, Lathrop, Howard, Hornbostel and Davidson, 6/0,
pas. sed.

EXECUTION OF LAND EXCHANGE AGREEMENT

Davidson indicated that staff had already gone over it and asked
fox' further Council comments and questions or motions.

Hornbostel moved that the Council approve the Execution of Land
Exchange Agreement of the Harper Street right-of-way vacation,
which the Land Exchange Agreement should be executed prior to the
second hearing of Ordinance 1125, Series 1993. Second by Lathrop.
Davidson asked for comments.

Griffith remarked that on Paragraph Four of the Agreement that
there is a blank that the closing is to occur on or before some
particular date. Do you have any date that I can fill that in
with?

Unknown - Not that they are aware of.
