Mayor Fauson thank Schuler and stated that on <br />behalf of the City Council it was a pleasure to <br />work with Schuler's firm and feels the facility is <br />top quality. <br />ORDINANCE #954 - SERIES 1988 - BROWN ANNEXATION - <br />PUBLIC HEARING Read by title only, Ordinance #954, Series 1988, <br />"An ordinance annexing to the City of Louisville, <br />Colorado, a parcel of property located on <br />Continental View Drive, which is owned by Paul N. <br />Brown and Susan J. Brown." Proof and publication <br />and notice of publics hearing were certified by the <br />City Clerk. <br />Mayor Fauson opened the public hearing. <br />McGuire explained that the applicant is requesting <br />the annexation of .98 acres of land located at 125 <br />Continental View Drive, north of South Boulder <br />Road. The applicant. is concurrently seeking <br />subdivision of the ground to create a second lot <br />which may be sold for a single family dwelling <br />site. Planning Commission reviewed this <br />annexation and recommend Council approve the <br />Ordinance. McGuire added that one issue that was <br />presented to staff was the understanding by a <br />neighbor that there was a covenance attached on <br />the property which would not allow subdivision of <br />the property. The title policy submitted by the <br />applicant failed to turn up such covenance. Staff <br />researched the issue at the County Clerk and <br />Recorder's Office which failed to turn up any <br />such covenance. However, in such case that the <br />something should come to light and a covenance <br />does exist, reference is made to the issue in the <br />Agreement. Staff recommends approval. <br />Mayor Fauson asked for any public comments either <br />in favor of or in opposition to Ordinance #954. <br />None. <br />With no further comments, Mayor Fauson closed the <br />public hearing and called for a motion. <br />Mohr moved and Anderson seconded to adopted <br />Ordinance #954, Series 1988.
