Louisville did agree to this Agreement in 1982 and <br />this Council will continue to honor this Agreement <br />in its original form. Mayor Fauson stated that <br />staff could continue talks with Superior to see if <br />there are any areas of negotiation. However, the <br />consensus is that Council is not interested in <br />negotiating a whole new agreement with the Town of <br />Superior. <br />Sackett stated that if it is at all possible to <br />give Superior some sort of feel for or some type <br />of method by whichh to do planning for their City <br />that would be beneficial to Superior, he would <br />like to see Louis~~ille pursue that. <br />Mohr stated that the 1982 Agreement was arrived at <br />by both the Town of Superior and the City of <br />Louisville at that: time. It is difficult for the <br />City of Louisville to state exactly when the <br />Howard Berry Treat:ment Plant will be on line <br />because it is coni~ingent on a lot of things. "The <br />Howard Berry Plant: is one of these consideration <br />which at this point is not necessarily a <br />priority...and quite frankly, the Water Agreement <br />we agreed to in 1982...was at the request of <br />Superior." "There are no surprises about that. <br />There should be no surprises about 1991...or <br />anyother date. Triere is nothing in the Agreement, <br />as I read it, which indicates that any of those <br />are significant ti.mes." "How do we know when we <br />are going to build that until our analysis <br />indicates that we should do that?" <br />Sackett asked i~f t:here was any way Louisville <br />could accommodate Superior prior to the Howard <br />Berry Plant. "I would like to ask the staff to <br />explore if there :is a way for us to assist <br />Superior without the Howard Berry Plant and <br />without jeopardizing our own water situation." <br />Ms. Belston stated that the original Agreement <br />refers to the construction of facilities at a <br />location north anti west of the Town of Superior. <br />It doesn't mention the Howard Berry facility <br />verbatim. Given that the City of Louisville is <br />planning the construction of a water storage tank, <br />Ms. Belston suggested that might constitute the <br />improvements north and west of the Town of <br />Superior. Ms. Belston asked if the tank could <br />take the place of the Howard Berry facility that <br />the Agreement probably eluded to in 1982 and if <br />so, when could Superior hook up to water service. <br />Hundley stated this could be taken under <br />advisement.
