that all water rights obtained by Superior pursuant <br />to the Water Rights Dedication Ordinance be turned <br />over to Louisville; and 8) Superior has also <br />deleted the language requiring that the only water <br />supplied within tYie corporate limits of Superior <br />must come from Louisville. <br />Ms. Belston stated. that it is her understanding <br />that Louisville's ;proposed Howard Berry Water <br />Treatment Plant will not be on-line until 1991. <br />It has been made clear that Superior will have <br />to wait until 1991. when the new water plant is <br />built. It has been Superior's understanding that <br />all Superior has t:o do is attach to an 18" line <br />stubbed in at Dillon and McCaslin, run a trans- <br />mission line under the highway and install a dis- <br />tribution system in order for Superior to be <br />supplied with water according to the 1982 Water <br />Agreement. It was even suggested that Superior <br />apply for a grant this year that would enable this <br />process to take place. Now, it appears that they <br />will have to wait at least until 1991 to hook up <br />to Louisville's s~-stem. <br />Ms. Belston said, "...what you see before you is <br />the optimal type of agreement that Superior would <br />like to see. Of course we are trying to make sure <br />that the people of Superior are best served. I <br />believe that Louisville would also do the same for <br />its people. We are willing to compromise on some <br />of these items." "If none of these changes are <br />agreeable, does our 1982 Agreement as written and <br />signed still stand., and if it does still stand, in <br />what year would bey the earli6st opportunity that <br />the Town of Superior would be able to hook up to <br />the Louisville system." <br />Dave Stahl, representing Homart Development, 400 <br />So. McCaslin, asked to speak regarding this <br />request. Mr. Stahl stated that Homart has a <br />concern that prior to Louisville approving any <br />additional commitments for utility service outside <br />the existing City limits, it would seem <br />appropriate that the water distribution study that <br />was done in 1979, updated in 1985, be updated <br />again. With all the additional commitments in the <br />City of Louisville since that latest update, i.e., <br />the health care park, the Biella-Menkick property, <br />etc., and also the fact that the infrastructure is <br />in place in the southwest part of the City, it <br />would seem appropriate to conduct some studies <br />incorporating these additional commitments prior <br />to negotiating any additional commitments outside <br />Louisville's corporate limits. <br />6 <br />
