Scott Carlson, owner and developer of Rock Creek
Ranch, stated than past and future history of
Superior and Louisville are tied together.
Superior's major c;oncern at this point is how can
the original residents of Superior get water
service. There has been an existing contract in
place since 1982 and as with any contract is open
to interpretation,. ''As a property owner in
Superior, what we would like to have is some type
of understanding, some type of agreement or pro-
cess by which we c;an move forward to get water
service to the original residents of Town, not to
my project. I do:n't think the contract even as
amended envisions service to Rock Creek Ranch in
total because the scope of the infrastructure will
not currently handle the area. I would like at
some point in time work with your staff and
Council to talk about regionalization of utilities
with Rock Creek Ranch paying our fair share and
helping to upgrade the facilities in the entire
Coal Creek, Rock Creek, Basin." "We would like to
have some type of clear direction, some type of
process that we c,an enter into that would get us
from where we are to where we need to be and where
we need to bei~,iate~r for 250 residents in the Town
of Superior so they can have an increased quality
of life... "
Mohr stated that .it is clear to him that during
the negotiations of the original 1982 Water Agree-
ment with the Town of Superior both parties had
something to bring to the table - the City of
Louisville was in need of a sewer agreement with
the Town of Superior and Superior 'wanted to ensure
that sometime in •the future they may have access
to water without having to go into the investment
themselves. "It seems to me that we have somewhat
of a problem and this is not so much a
modification of our existing Agreement as it is a
proposal for an entirely new agreement. Most of
the articles...speak to changing the content, the
substance of that Agreement in its entirety and
the real question that I have to ask of
myself ...what is it you bring to the table for us.
You are asking us to change everything as I read
it to your favor.'''
Ms. Belston responded stating that what the Town
of Superior has to offer the City of Louisville is
$600,000 in tap fees. Beyond that if there are
any ideas that Louisville would like to propose,
the Town of Superior would consider those
proposals. The Town Board is fully aware
that Louisville wall most likely want to negotiate
in the proposed amendment.
7
