Wanush explained that a letter and petition from the <br />1007 Corporation was received requesting the <br />annexation of approximately 9.9 acres of land. This <br />land is located in the southwest quadrant of Dyer <br />Road and old McCaslin Blvd. They are requesting <br />Commercial-Business (C-B) zoning. The petition meets <br />the requirements of the state annexation statute and <br />1007 Corporation are the owners of 100$ of the land <br />to be annexed exclusive of rights-of-way. 48~ of the <br />property is contiguous to existing city limits. <br />Staff recommends Council adopt Resolution #33 and set <br />a public hearing fo:r December 15, 1987. <br />Mayor Fauson moved that Council adopt Resolution #33 <br />and a public hearing be set for December 15, 1987. <br />Mohr seconded. Unanimous. <br />PUBLIC SERVICE FRANCHISE <br />AGREEMENT Hundley explained that last week, the City received <br />notification by the Public Service Co. of Colorado of <br />an increase in the franchise fee to be paid to the <br />City of Louisville by virtue of an automatic increase <br />contained in the Cii~y's franchise agreement with <br />Public Service. Effective November 1, 1987, the <br />franchise fee will be increased from 2~ to 3~ for any <br />customer in Louisville, at any one location, whose <br />annual gross revenue from the sale of gas and <br />electricity is in excess of $5,000. The City will <br />receive approximately $43,000 in additional revenues <br />during 1988 as a re:~ult of the higher franchise fee. <br />This is an automatic increase and requires no action <br />on the part of Council. <br />Szymanski asked what the term is of the current <br />franchise agreement„ Hundley explained that it is a <br />20 year agreement signed in 1977. The impact would <br />be on large scale u:~ers and STC is the largest user <br />in Louisville. <br />OTHER: <br />COAL CREEK PROJECT Hundley stated that staff received today the <br />majority of the submittal package required for the <br />annexation of the Coal Creek Project. Hundley asked <br />that a Work Session be held on Wednesday, Nov. 11th <br />at 7:30 p.m. The remaining documents will have been <br />submitted by this time and the Nov. 11th meeting <br />will be a joint session with the Planning Commis- <br />sion and the Golf A:;sociation so that everyone can <br />see the proposed project in full detail. <br />APPROVAL OF EASEMENT AGREEMENTS WITH PUBLIC SERVICE COMPANY AND HOMART <br />DEVELOPMENT CORP. Phare brought to Council the final two easements <br />needed for the City's 24" Treated Water Pipeline from <br />the 2.0 MG High ZonE~ Storage Tank to the existing <br />distribution system.
