Publication and notice of public hearing were established. Mayor Fauson opened the public hearing. Wanush stated that the owners of a .175 acre parcel located on Spruce Lane requested annexation and RR zoning. The applic<~nt, Spruce Street Joseph, Ltd. wishes to correct the legal description of the Joseph-Prouty-Fiechi:l annexation (known as the Spruce Lane parcel) by adding this small strip of land which was inadvertently omitted from the prior annexation. Planning Commission reviewed the annexation request and determined that it met all municipal and state criteria regarding annexation. They recommended apX>roval without conditions. Mayor Fauson asked i:or any public comments either in favor of or in oppo:>ition to Ordinance #944. None. Mayor Fauson closed the public hearing and called for a motion. Mohr moved that Ordinance #944 be adopted. Anderson seconded. By Roll Call Vote Ordinance #944 was adopted unanimously. ORDINANCE #945 - SPRUCE STREET LTD AND JAMES LEACH ZONING - PUBLIC HEARING Rautenstraus read by title only Ordinance #945, "An Ordinance amending Z'itle 17 of the Louisville Muni- cipal Code entitled "Zoning" by zoning property owned by Spruce StrE:et Joseph LTD and James Leach." Publication and notice of public hearing were estab- lished. Mayor Fauson opened the public hearing. Wanush asked that his comments during the previous Agenda item concerning the annexation of the property be accepted at part of the record for this zoning ordinance. The zoning request is for R-R (Rural-Residential) which is consistent with the neighboring parcel's designation. The square footage of this request has already been calculated in lot sizes for the Spruce Lane Subdivision and Planning Commission reviewed the proposed zoning and determined that it was appropriate. Mayor Fauson called for any comments either in favor of or in opposition to Ordinance #945. None. Mayor Fauson closed the public hearing and called for a motion. 8
