develop a new zoning code that would apply to those <br />areas around interchanges. Szymanski was concerned <br />with regard to the specifics of the language pro- <br />posed by Planning Commission such as what can be <br />included in gas stations. This particular piece of <br />property would become somewhat of an entry into the <br />City and Szymanski feels that up to this point, <br />Council has taken stringent steps as to what the <br />City's entry features will look like. "I don't <br />recall ever seeing a gas station that makes an <br />attractive entry feature." "I don't know if I would <br />want a gas station as part of an entry feature if <br />that's what this classification is." <br />Hundley stated that staff proposed that as a <br />condition of annexation, it be understood that these <br />restrictions will apply, because the City can not <br />place them on the zoning as that would be a type of <br />conditional zoning. Yet, Planning Commission feels <br />very strongly that that is an entry area and <br />consistent with Council's direction, staff wanted to <br />take every precaution needed to make sure that the <br />area remains an attractive entry into the City. The <br />technique that was used was to include conditions <br />as part of the annexation ordinance. Drafting an <br />additional zoning category will take some time to <br />develop. <br />Szymanski agreed that it would take some time to <br />draft a new zoning ordinance yet he felt that there <br />would most likely be other request in the near <br />future and feels that this is the time to begin the <br />process of developing an appropriate zoning for <br />areas similar to this. <br />Mayor Fauson stated that a zoning ordinance would <br />probably end up having the same criteria similar to <br />the conditions that are being attached to the pro- <br />posed annexation ordinance for this piece of <br />property. <br />Anderson stated, "This is the first interchange we <br />have to work with. I think that's way its so <br />important that we deal with it now. I realize that <br />we are not making a decision on annexation and <br />zoning tonight - that will be decided at the public <br />hearing, but I think the comments that are being <br />made are appropriate so that the petitioner has the <br />opportunity to address them." "We do have the <br />unique opportunity here in that we have an isolated <br />site that will set the tone for what does happen <br />around this interchange and others." <br />5 <br />
