Unanimous. <br />ORDINANCE #947 - DYER ROAD ZONING - 1ST READING - <br />SET PUBLIC HEARING Rautenstraus read by title only Ordinance #947, "An <br />Ordinance amending Title 17 of the Louisville <br />Municipal Code entitled "Zoning" by zoning property <br />owned by 1007 Corporation." Permission is being <br />sought to place the Ordinance out for publication <br />and a public hearing set for January 19, 1988. <br />Mayor Fauson moved and Scarpella seconded that <br />Ordinance #947 be placed out for publication and <br />public hearing set for January 19, 1988. Unanimous. <br />REQUEST FOR CHANGE IN ZONING <br />ORDINANCE Hundley explained that earlier this year, Tina <br />Tincher, owner of Hair Unlimited, asked whether or <br />not she could more her beauty salon from its current <br />location to her home located at 600 Short Street. <br />In reviewing the City's zoning ordinance, City staff <br />determined that this use was not allowed in a <br />residential zone. Two weeks ago, Ms. Tincher <br />requested that the City consider amending its zoning <br />ordinance to allow this use. Louisville's Municipal <br />Code regarding zoning amendments is clear as to the <br />amendment procedure: 1) study and recommendation on <br />the proposed amendment by the Planning Commission; <br />and 2) completion of a public hearing before the <br />City Council after at least 15 days notice of the <br />time and place of such hearing has been given. <br />Staff recommends that Council refer this request to <br />the Planning Commission for further study and <br />recommendation. <br />Ms. Tincher addressed Council stating that she would <br />like move her business to her home. She would be <br />the only beauty operator and there would only be one <br />station. She lives on a corner and there would be <br />adequate parking. She is planning an addition on to <br />her home for this use and would like to have Council <br />consider changing the current zoning ordinance that <br />specifically excludes beauty operations under the <br />Home Occupation section of the City of Louisville <br />Municipal Code. <br />This type of amendment would require an ordinance <br />change and must go through the Planning Commission <br />process. <br />Mayor Fauson moved that this request for ordinance <br />change be referred to the Planning Commission. <br />Sackett seconded.
