RESOLUTION #18 - SUBDIVISION AND <br />PUD AGREEMENT - SADDLEBACK II <br />(Note: This Resolution was incorrectly listed as <br />Resolution #14 in Council packets) <br />SADDLEBACK I This property contains 27.36 acres and is <br />generally located north of Via Appia and east of <br />Tyler. McStain proposes to develop 86 single <br />family lots. The property is zoned R-E and the <br />subdivision and PUD meet the requirements of the <br />City Code. <br />SADDLEBACK II This subdivision contains approximately 34 acres <br />and is generally located north of Tyler and west <br />of Washington Street extended. McStain proposes <br />to develop 78 single family lots and create a <br />homeowner's association to maintain all open <br />space. This property is zoned R-E and meets all <br />requirements of City Code. <br />The Planning Commission approved the Saddleback <br />Subdivision and PUD Filing #1 and Filing #2 at <br />their meeting on September 10, 1985, with eight <br />conditions: 1) No building permits may be issued <br />until the Fire Department approves the design and <br />the Public Works Department approves the design <br />and completion schedule of Via Appia, Tyler Ave. <br />and Washington Ave.; 2) No more than 30 <br />Certificates of Occupancy for either Filing #1 <br />and/or Filing #2 are to be issued until Via Appia <br />is completed to McCaslin Blvd.; 3) Washington Ave. <br />as referred to above is the ROW from Tyler Ave. to <br />Hillsborough West where it intersects West <br />Tamarisk Street; 4) Washington Ave. is to be <br />"roughed in" from Tyler Avenue to McCaslin Blvd. <br />for construction traffic so that Washington Ave. <br />through Hillsborough West is not used by <br />construction traffic; 5) No development amy occur <br />further than 500 feE~t from any single access <br />point; 6) Public Works must approve all drainage <br />and grading plans; ;-) Community Services must <br />approve all landscaping plans in open space areas; <br />8) No open space areas shall be developed by the <br />City unless Community Services and McStain have <br />jointly agreed that dedication would benefit the <br />City and unless the landscaping and maintenance of <br />the open space meet:c standards as determined by the <br />Department of Community Services. Open space not <br />dedicated to the City must be maintained by the <br />developer or by any other arrangement (e.g. <br />homeowners association, improvement district, <br />etc.) acceptable to Community Services. <br />3 <br />
