Local Licensing Authority <br />Minutes <br />February 22, 2016 <br />Page 4 of 6 <br />patrons, servers at another establishment and the police all reported the party <br />as being visibly intoxicated. He realized it is busy during the summertime and <br />suggested the servers slow down a bit and observe the patrons before serving. <br />Mr. Karp stated he did not want to argue or get anything changed. He wanted <br />to express his opinion and understand the proceedings. <br />Chairperson Tennessen asked Mr. Karp to understand the Authority having a <br />difficult job in determining from a police report when the line is crossed. He <br />assured Mr. Karp the Authority strives to be very fair. <br />Authority member Machado noted his appreciation of how Waterloo has <br />worked with the police department and the way the establishment has been <br />handled. He noted he could not predict what might have happened had the <br />evidence been presented at a hearing. He hoped the good work would <br />continue. <br />Mr. Karp assured the good work would continue. He felt going to hearing <br />would have been a risky business decision. <br />Authority member Lipton noted a show cause hearing would give the Authority <br />the opportunity to hear the story from the licensee's point of view. A stipulation <br />had been accepted in this case so no hearing occurred. <br />Mr. Karp noted he made the decision to accept the stipulation based on the <br />information provided by the Authority's special prosecutor. He wanted the <br />Authority to know the establishment tries hard to comply with the classes and <br />have an educated, well- trained staff to keep people safe. The incident was not <br />taken lightly. <br />Mr. Stoneman wondered if a show cause hearing should have been held and <br />then a stipulation agreed upon. <br />Chairperson Tennessen noted in the two years on the Authority this was only <br />the second show cause ordered. He noted the stipulation could have been <br />rejected by the licensee. Mr. Stoneman and Mr. Karp felt the decision to not <br />accept the stipulation would have put the business in too much risk. <br />Authority member Carlson thanked the licensee for the comments and <br />understood the pragmatic approach taken to run the business. He appreciated <br />the Authority getting to see how the process plays out behind the scenes for <br />the licensee. <br />
