Louisville City Council Meeting <br />April 15, 2003 <br />Page 3 of 14 <br /> <br />City Attomey Sam Light read Ordinance No. 1418, Series 2003. <br /> <br />Davidson called for Staff presentation. <br /> <br />Public Works Director Tom Phare reported the proposed Highway 42/96th Street roadway <br />and utility improvements would traverse the Schreiter property, located at the southeast <br />comer of Dillon Road and South 96th Street. The ordinance authorizes the acquisition of <br />the land for right-of-way and easement purposes from this property. He reported that <br />problems have developed in the negotiations. <br /> <br />Davidson opened the public heating and asked if anyone in the audience wished to speak <br />in favor or against Ordinance No. 1418, Series 2003. There were no comments <br /> <br />COUNCIL COMMENT <br /> <br />Keany asked if there was a way for the connection to go through an open space right-of- <br />way in lieu of condemning property. Phare stated the road has been shifted over, <br />however there is no way to build the road without the Schreiter property. <br /> <br />Sisk asked that the negotiations be reopened to avoid condemnation. Phare stated City <br />Manager Simmons would discuss the issues with the property owner. City Manager <br />Simmons stated every effort would be made to resolve this matter without condemnation. <br /> <br />Keany asked if the Schreiter's home is impacted by the connection and if there were any <br />measures available to limit the impact, such as noise abatement. Phare stated the 30' <br />section required is on the south end of the property where the Schreiter home is located. <br />Simmons stated the discussion would center on Mr. Schreiter's issues. <br /> <br />Keany asked that Council member Sisk be included in the discussions. Davidson asked <br />for drawings on the configuration of the highway. <br /> <br />MOTION: Sisk moved for Council approval of Ordinance No. 1418, Series 2003, <br />seconded by Levihn. Roll call vote was taken. The motion passed by a 7-0 vote. <br /> <br />ORDINANCE NO. 1419, SERIES 2003 - AN ORDINANCE AMENDING TITLE <br />17 OF THE LOUISVILLE MUNICIPAL CODE, ENTITLED "ZONING", BY <br />REZONING APPROXIMATELY 3.2 ACRES WITHIN THE COLORADO <br />TECHNOLOGICAL CENTER FROM THE COMMERICAL BUSINESS TO THE <br />INDUSTRIAL ZONE DISTRICT - 2ad reading - public hearing (advertised Daily <br />Camera 4/5/03) <br /> <br />Davidson called for City Attorney introduction. <br /> <br />City Attomey Sam Light read Ordinance No. 1419, Series 2003. <br /> <br /> <br />
