Levihn did not see any evidence of any previous Council comments or handshakes, or any thing,
which he wanted to see before he could go with this.

Morris offered to make those documents available.

Griffiths asked Morris if he would continue to wish to have his land annexed to the city if it was to
be zoned to a density lower than SF-MD, such as R-RR, in accordance with the Comprehensive Plan..

Morris:

I would not chose to have it zoned that way. No.

Griffiths:

Would you wish to have it annexed, if it was to be
zoned that way?

Morris: No.

Mayer stated that there are no formal agreements in place that show that the city owes anything. The
residents have stated that they want the land zoned R-RR. He stated that R-RR would preserve the
natural beauty of the area and minimize the impact on the schools.

Sisk was agreeable to the annexation and felt the zoning should be A-OT between Washington and
Kennedy, with the balance from Kennedy westward being R-RR.

Lathrop did not feel R-RR zoning was appropriate for that area. He felt the A-0T zoning was
reasonably acceptable. He did support annexation.

Griffiths clarified that what was before Council was three separate items: Resolution No. 54, stating
the annexation petition is in compliance with state law, sets a hearing for December 6 to finally
determine whether the proposed annexation complies with state law, and to have a hearing on that
issue; Ordinance No. 1165, is annexing the property. This is the first reading, with second reading
being on December 6, 1994; and Ordinance No. 1166, zoning the property, with first reading at this
meeting and second reading on December 6, 1994. She commented that through this process Mr.
Morris would be able to withdraw his petition between first and second reading, if he so chose.

RESOLUTION NO. 54, SERIES 1994 - SUBSTANTIAL COMPLIANCE -
LOUISVIEW CORPORATION - ANNEXATION

Mayer moved that Council approve Resolution No. 54, Series 1994 and set a public hearing for
December 6, 1994. Seconded by Sisk. All in favor with Davidson being absent.

ORDINANCE NO. 1165, SERIES 1994 - ANNEXATION OF LOUISVIEW
CORPORATION PROPERTY - 1ST READING - SET PUBLIC HEARING 12/6/94

10
