Levihn wondered if they had contributed to South Boulder Road and McCaslin improvements. <br /> <br />Morals stated that they had not. He stated that he had agreed with the Council, at that time, that if <br />they give him commercial, he would share the cost, but not if it was residential. <br /> <br />Sisk wanted names of people involved. <br /> <br />Morris offered to get documents that were drawn up, but never signed, so never materialized. <br /> <br />Sisk asked Ostrander if the rough drafts rose to the level of a contract between his client and the City <br />of Louisville. <br /> <br />Ostrander stated they had not. <br /> <br />Sisk wondered if the 1986 Comp Plan was the Comp Plan that should be utilized by this Council. <br />Ostrander stated "no," because that showed commercial for that area. <br /> <br />Sisk wondered what had been planned between Kennedy and Washington under the other Council. <br /> <br />Ostrander stated similar density as what is on Neodata, which is approximately three times more <br />dense. <br /> <br />Sisk stated that in terms of open space, they couldn't build on the ditches anyway, they would have <br />to be right-of-ways. <br /> <br />Morris offered to pipe the ditch and cover it, and allow Louisville to still have the land. <br /> <br />Keany stated that, from comments he had received from citizens, nothing should be built on that <br />property. He wondered if Morris would be willing to look at less density. <br /> <br /> Morris did not feel he could go with less density. <br /> <br /> Howard asked if handshake agreements between prior Councils obligated this Council. <br /> <br /> Susan Griffiths, City Attorney, stated that as far as she knew, there were no binding agreements <br /> between Mr. Morris and the City Council with respect to this property. <br /> <br /> Howard asked the City Attorney if this parcel met the requirements of the city and state to force <br /> annexation. <br /> <br /> Griffiths stated that as a single parcel, since there was 95% contiguity between this parcel and the <br /> boundaries of the city, the property owner could force annexation on the city, not a particular zoning. <br /> <br /> <br />
