Franklin stated that this is one of the items, design guidelines,
that the Planning Commission is going to consider for part of the
work program for the Comprehensive Plan, to see if it's worthy, if
the policies are still afresh, and whether it worthy of
incorporating into the Comprehensive Plan.

Ail in favor with the exception of Councilman Howard.
declared the denial of the fence exemption as amended.
the whole policy to be reviewed.

Davidson
And, for

Lin:

Will I hear from the Council once
this has been reviewed?

Davidson:

You will hear from John Franklin,
Director of Community Development.

RESOLUTION NO. 28, SERIES 1992 - MATTERN ANNEXATION - PUBLIC
HEARING

John Franklin, Director of Community Development, commented that
Mr. Mattern's property is totally surrounded by the City of
Louisville. Mr. Mattern is interested in being annexed into the
City, so that he might be able to replace a second, manufactured
home on the property, which under the County regulations he could
not do, as the property was too small. Under City zoning
regulations, as was discussed, as the Ordinance has been amended,
and under the annexation agreement, Mr. Mattern could have the
existing home and could replace the second, manufactured home,
which is the one of concern. Mr. Mattern has a well, and septic
tank that is in good shape. However, his property adjoins the
Colorado Tech Center water and sewer main to the west. He would
like, as part of this agreement, to not have the City require that
he hook up until the year 2000. The Planning Commission reviewed
this request and did recommend approval. The Resolution is abiding
by State Statutes, as are the succeeding two Ordinances.

George Mattern, 1296 S. 104th St., Broomfield, CO.

Mattern:

It's inevitable, because the City
has me surrounded. I'm an island.
So in your wisdom, go ahead with the
project.

Susan Griffiths, City Attorney.

Griffiths:

On Exhibit C, to the annexation
agreement, there are no water rights
that appertain to the property. Is
that correct?

Mattern:

The water rights were taken over by
Misel, MDC, and were supposed to

11
