Lathrop: Johnson: Lathrop: Franklin: How long have you owned the home? Since September of 1991. John, could Mr. Johnson build a fence inside of his lot line at 6 ft., and if so, at what distance? Mr. Johnson could build a 6 ft. privacy fence with a height of up to the maximum height as long as he observed the setback requirements, which I recall to be 25 ft. Lathrop: Johnson: I am concerned about a policy change on an individual basis, especially fencing on open space. I bought this home because of the size of the yard for our dogs. I don't feel like cutting up the yard when I could put up a fence along the property line. When you look across Via Appia and around the lake, there are several houses with 6 ft. privacy fences. On my side of Via Appia, there are other lots bordering the same open space which have 6 ft. fences also. Lathrop: I think, to some degree, you may be being singled out or being penalized for being forthright. In my opinion, if I say it's okay for Mr. Johnson, then I'd have to say it's okay for everyone else. Hornbostel: We need to look at the whole policy. Lathrop moved that Council deny the request for a 6 ft. privacy fence on open space. Hornbostel made a friendly amendment to examine the policy on design guidelines in terms of privacy fences on open space. Lathrop refused the friendly amendment. Seconded by Mayer. Mayer made a amendment to revisit the guidelines and make sure that Council has a consistent policy that's being followed consistently, and that still meets the initial objectives of that policy. Seconded by Hornbostel. All in favor with exception of Councilman Lathrop. 10
