Howard:

Davidson:

this, consider the situation that
once you start doing this, most
everyone will want one. What
happens if in 10 or 15 years from
now you need that right-of-way?
Even if legally we could take all of
those fences down, it's an
undesirable way of proceeding. I
would urge great caution in giving
up the City right-of-way.

I'm concerned about safety, signage
safety, as well as turning a corner
from West Dahlia Street to West
Dahlia Court. I would want to know
if the imposition of a 6 ft. fence
that close to a sidewalk would not
cause any safety concerns. I would
want to make sure that we don't
cause either a safety problem or any
other foreseeable problem.

Because the street curves, there is
less visibility. There would not be
room for normal street signs. You
would have to have enough room to do
whatever signage you might want to
do in the future.

Sisk:

Stein:
Sisk:

Stein:

Sisk:

Dr. Stein, did you commence
construction on this project without
getting a license?

No, I got a permit for it.

When did you first become aware that
you were building in the City's
right-of-way?

I guess I didn't understand that I
could only put it so many feet out
on the site plan. When Kirk (Chief
Building Inspector) came out and put
a Stop Work order on it, he told me
I could only go 15 ft. out from the
corner of my garage, according to my
site plan, which is 11 ft. back from
the sidewalk. I got the permit at
the end of April and the fence
wasn't started until the end of May.

Did you give the site plan to the

12
