Dahlia, being within 2 1/2 <br />ft. of the sidewalk, within the City right-of-way. Seconded by <br />Sisk. <br /> <br />Howard: <br /> <br />Does this obviate the need to have <br />staff look into their need for such <br />a wide easement, or does it not? <br /> <br />Lathrop: <br /> <br />I would suggest that we look at the <br />information that Public Works puts <br />together justifying needs for this <br />right-of-way. If we feel that there <br />is some need to grant some leniency <br />as far as the distances, then we <br />could do it then. <br /> <br />Mayer: <br /> <br />I know the applicant has a retaining <br />wall built right up against the <br />fence. I really don't want to take <br />any more than is required here, but <br />on the other hand, I understand it's <br />an expense, but I don't want to take <br />any less than what the City needs. <br />I would support Councilman Lathrop's <br />motion to deny, but then request the <br />City staff to see what we really do <br />need.
