We went by what was in the <br />area. <br /> <br />Mayer: <br /> <br />Tom Phare, do you feel that the 7 <br />ft. of right-of-way, given the <br />current development of that <br />neighborhood, is required or is that <br />something you'd want to think about? <br /> <br />Phare: <br /> <br />It would be best if we went back and <br />looked at a few possible reasons <br />that we might want that as right-of- <br />way in the future, so Council can <br />see potentially what you're giving <br /> <br />Lathrop moved that Council deny the request to provide a Revocable <br />License for a privacy fence at 802 W. Dahlia, being within 2 1/2 <br />ft. of the sidewalk, within the City right-of-way. Seconded by <br />Sisk. <br /> <br />Howard: <br /> <br />Does this obviate the need to have <br />staff look into their need for such <br />a wide easement, or does it not? <br /> <br />Lathrop: <br /> <br />I would suggest that we look at the <br />information that Public Works puts <br />together justifying needs for this <br />right-of-way. If we feel that there <br />is some need to grant some leniency <br />as far as the distances, then we <br />could do it then. <br /> <br />Mayer: <br /> <br />I know the applicant has a retaining <br />wall built right up against the <br />fence. I really don't want to take <br />any more than is required here, but <br />on the other hand, I understand it's <br />an expense, but I don't want to take <br />any less than what the City needs. <br />I would support Councilman Lathrop's <br />motion to deny, but then request the <br />City staff to see what we really do <br />need. Maybe we could suspend <br />further proceedings against removal <br />of the post, until we know exactly <br />what is required. <br /> <br />13 <br /> <br /> <br />
