Davidson:

rights-of-way and so on .... We all
know what their work load is.

Tom, how long do you think it would
take staff to do this

Phare:

I would guess two days.

Howard was concerned about the school there. That school was not
originally thought to go in that location. That occurred because
of a previous overcrowding and land that was available, mix and
match, which threw up in the air the original planning that went
into that area. He is not a big advocate of the City giving up its
rights. However, he is willing to look into the subject, since a
school was put in a place that wasn't originally designed to have
such an entity. He's not sure that the original premise that the
plat was put under still makes since. That's why he is willing to
court an effort to determine what the effects of putting the school
versus our need for the collector road.

Sisk:

The school is there. In my mind we
should have as wide a right-of-way
as possible. It may be that we want
a loading zone or that we'll have
other needs. That's why I'm opposed
to trying to re-think this issue.

Mayer restated the motion that Council direct City staff to examine
the need for the 70 ft. right-of-way and to postpone requiring Dr.
Stein to move the fence until we know exactly what that right-of-
way is going to be. Roll call was taken. Motion failed by a 3-3
vote with Hornbostel, Lathrop, and Sisk voting against.

ORDINANCE NO. 1079, SERIES 1992 - CONCERNING ETHICS, OPEN
GOVERNMENT, OPEN MEETINGS, AND EXECUTIVE SESSIONS, AND PROVIDING
PENALTIES FOR VIOLATION THEREOF - 2ND READING - PUBLIC REARING
(PUBLISHED IN LOUISVILLE TIMES - 7/22/92)

Griffiths read by title only Ordinance No. 1079, Series 1992, "An
ordinance concerning ethics, open government, open meetings, and
executive sessions, and providing penalties for violation thereof."

Davidson opened the Public Hearing asking the City Attorney for an
introduction.

Giffiths:

Council, you're familiar with this
ordinance. The version that you
have in your packet does not contain
the amendments that we did approve
on first reading at your last
meeting.
