APPROVE REQUEST TO CHANGE LOCATION - AMERICAN T.~.GION WALTER RHODES <br />POST #111 - PUBLISHED LOUISVILLE TIMES 8/19/92 AND LOCATION POSTED <br />8/19/92 - PUBLIC HEARING <br /> <br />Davidson opened the Public Hearing on the application of the <br />American Legion Walter Rhodes Post #111 for a change of location of <br />its Liquor License from 628 LaFarge Street to 1130 Pine Street. <br /> <br />Davidson: <br /> <br />The Liquor Licensing Authority, <br />which is the City Council, must set <br />the boundaries of the neighborhood <br />for the License. In the past, the <br />boundaries have been set at the <br />current boundaries of the City of <br />Louisville. I move that the <br />boundaries be so set for this <br />application. Is there a second? <br /> <br />Seconded by Howard. <br /> <br />Davidson asked if there was anyone in the audience who objected to <br />the boundaries of the neighborhood being the current boundaries of <br />the City of Louisville. <br /> <br />NONE <br /> <br />Ail in favor. <br /> <br />Davidson further moved that the complete application filed with the <br />City by the applicant, a copy of which had been made available to <br />each member of the Authority, be made a part of the record of this <br />Hearing. He asked if anyone present objected to this motion. <br /> <br />NONE <br /> <br />Seconded by Lathrop. Ail in favor. <br /> <br />Susan Griffiths, City Attorney, stated that in considering the <br />application filed by the American Legion, the City Council is <br />acting in a quasi-judicial capacity as the Local Licensing <br />Authority of the City of Louisville under Colorado law. The <br />Authority's decision must be based on the evidence presented to it <br />during the hearing tonight and the legal requirements set out in <br />state laws. Under state law, the Authority must consider the <br />reasonable requirements of the neighborhood to which the applicant <br />seeks to change its location and the desires of the adult <br />inhabitants. The character of the applicant is not an issue in an <br />application for a change of location. <br /> <br />Davidson asked for the representative of the applicantion to please <br />come forward to make their presentation. <br /> <br />3 <br /> <br /> <br />
