APPROVE REQUEST TO CHANGE LOCATION - AMERICAN T.~.GION WALTER RHODES POST #111 - PUBLISHED LOUISVILLE TIMES 8/19/92 AND LOCATION POSTED 8/19/92 - PUBLIC HEARING Davidson opened the Public Hearing on the application of the American Legion Walter Rhodes Post #111 for a change of location of its Liquor License from 628 LaFarge Street to 1130 Pine Street. Davidson: The Liquor Licensing Authority, which is the City Council, must set the boundaries of the neighborhood for the License. In the past, the boundaries have been set at the current boundaries of the City of Louisville. I move that the boundaries be so set for this application. Is there a second? Seconded by Howard. Davidson asked if there was anyone in the audience who objected to the boundaries of the neighborhood being the current boundaries of the City of Louisville. NONE Ail in favor. Davidson further moved that the complete application filed with the City by the applicant, a copy of which had been made available to each member of the Authority, be made a part of the record of this Hearing. He asked if anyone present objected to this motion. NONE Seconded by Lathrop. Ail in favor. Susan Griffiths, City Attorney, stated that in considering the application filed by the American Legion, the City Council is acting in a quasi-judicial capacity as the Local Licensing Authority of the City of Louisville under Colorado law. The Authority's decision must be based on the evidence presented to it during the hearing tonight and the legal requirements set out in state laws. Under state law, the Authority must consider the reasonable requirements of the neighborhood to which the applicant seeks to change its location and the desires of the adult inhabitants. The character of the applicant is not an issue in an application for a change of location. Davidson asked for the representative of the applicantion to please come forward to make their presentation. 3
