City Council <br />Meeting Minutes <br />May 6, 2008 <br />Page 16 of 17 <br />Councilor Sackett inquired about Question 24 relative to trails and underpasses. <br />It was suggested the question be changed to trails and pedestrian underpasses. <br />MOTION: Mayor Sisk moved to approve the citizen's survey with the following <br />revisions: Question 20, revise to delete reference to downtown so that question <br />relates to development of areas east of the railroad tracks; Question 24, insert <br />"pedestrian" before "underpa;>ses"; Questions D8 and D9, delete unless the <br />consultant has a statistical reason for including them, seconded by Councilor <br />Clabots. <br />MOTION: Councilor Muckle moved to add a new question asking to what extent <br />do you support or oppose changes in zoning to allow new or additional <br />residential development in areas west of McCaslin Boulevard, seconded by <br />Councilor Sackett. <br />Roll call vote was taken on the amendment. The motion carried by a vote of 5-2. <br />Mayor Pro Tem Marsella and Councilor Dalton voted no. <br />Roll call vote on the main mottion was taken. The motion carried by a vote of 7-0. <br />CITY ATTORNEY'S REPORT <br />City Attorney Light reported the defense counsel in the Hamon case, Mr. Liechty, <br />had been contacted by another attorney representing Hamon who inquired <br />whether the City is interested in pursing further mediation. City Attorney Light <br />asked whether Council was interested in an additional mediation, and suggested <br />one option was to request Hamon pay a higher share of the mediator costs given <br />one mediation has already bE~en completed. There was Council consensus to <br />pursue mediation; Councilors Marsella and Dalton indicated they would be willing <br />to attend the mediation. <br />City Attorney Light also reported the litigation involving the North Metro Fire <br />District fire station site, stating the District has requested a stay of the litigation <br />until August. He stated settlement discussion have been proceeding, with further <br />discussion needed on issues related to gateway signage, open space funding <br />and potential conservation easements. <br />COUNCIL COMMENTS AND COMMITTEE REPORTS <br />Mayor Pro Tem Marsella reported at the last meeting of the Louisville Housing <br />Authority they adopted a smoke free policy in all their facilities. <br />Councilor Clabots thanked the Staff and volunteers for their efforts on Arbor Day. <br />ADJOURN <br />
