City Council <br />Meeting Minutes <br />July 1, 2008 <br />Page 7 of 11 <br />RESOLUTION No. 29, SERIES 2008 - A RESOLUTION APPROVING A <br />PURCHASE CONTRACT TO BUY AND SELL REAL ESTATE FOR <br />ACQUISITION OF CERTAIN RIGHT-OF-WAY REQUIRED FOR THE DILLON <br />ROAD PROJECT <br />Public Works Director Tom Phare stated the Dillon Road project will provide <br />drainage and roadway improvemeni:s on and adjacent to Dillon Road from 96tH <br />Street to east of South 104tH Street. He explained the Public Works department <br />has been negotiating with Mr. Dave Keown for the acquisition of 53,900 SF of his <br />property, which is needed to construct the Dillon Road Project. The City will pay <br />$82,000 for the property and Mr. Keown has agreed to the terms and conditions <br />of the purchase contract. As part of the right-of-way transaction, Mr. Keown also <br />agreed to relocate one of his driveways. If Mr. Keown does not complete all the <br />requirements of the contract by the :,losing date, the contract provides for <br />immediate possession by the City aind a payment of a reduced price of $67,000. <br />The right-of-way transaction will be ifunded from the Dillon Road Project. <br />COUNCIL COMMENT <br />Mayor Pro Tem Marsella requested clarification on the selling price. City <br />Attorney Light confirmed if the term;> of the contract are not met the selling price <br />would be $67,000. <br />MOTION: Councilor Dalton moved 'to approve Resolution No. 29, Series 2008, <br />seconded by Mayor Pro Tem Marsella. Roll call vote was taken. The motion <br />carried by a vote of 7-0. <br />ORDINANCE No. 1538, SERIES 2008 - AN ORDINANCE AMENDING <br />CERTAIN SECTIONS OF CHAPTER 15.36 OF THE LOUISVILLE MUNICIPAL <br />CODE, REGARDING HISTORIC PRESERVATION, TO REVISE THE <br />PROCEDURES APPLICABLE TO DEMOLITION REVIEW OF BUILDINGS <br />THAT ARE OVER FIFTY YEARS OLD - 1ST Reading -Set Public Hearing <br />7/15/08 <br />Mayor Sisk requested a City Attorney introduction. <br />City Attorney Light read Ordinance IVo. 1538, Series 2008. <br />Mayor Sisk requested public hearing. There were no comments. <br />MOTION: Mayor Sisk moved to approve Ordinance No. 1538, Series 2008 on <br />first reading, send it out for publication and set a public hearing for July 15, 2008, <br />seconded by Councilor Sackett.
