The BAP is contingent upon the <br />opening of the restaurant no later than January 30, 2009. The City would rebate <br />40% of the incremental sales tax revenues derived from the imposition of the <br />3.0% general sales tax for the first i~our years of operation and be Gaped at <br />$64,800. In the event Beef `O' Brady's Family Sports Pub terminates their <br />business within the first 5 years, Br;asel LLC would pay back the total amount of <br />sales tax rebated by the City. <br />Mr. Richard Womack, representing Beef `O'Brady's Family Sports Pub, gave a <br />brief history of the business, a familly sports restaurant franchise, which started in <br />Florida. He noted there are 120 Beef O'Brady's Family Sports Pub in Florida <br />alone. The restaurant is very involved in youth sports. The proposal for the <br />Louisville site will cover the corner area of the Village Square Shopping Center, <br />including the area occupied by Curves. This restaurant will be the first Beef <br />`O'Brady's Family Sports Pub in Colorado and will serve as a training facility for <br />future Beef `O'Brady's Family Sports Pub restaurants. <br />COUNCIL COMMENT <br />Mayor Pro Tem Marsella asked if tree incentive is given for this restaurant only. <br />Ms. Hogan confirmed the sales tax incentive is for this Beef `O'Brady's Family <br />Sports Pub only. <br />MOTION: Mayor Pro Tem Marsella moved to approve Resolution No. 30, Series <br />2008, seconded by Councilor Bob Muckle. Roll call vote was taken. The motion <br />carried by a vote of 7-0. <br />ORDINANCE No. 1538, SERIES 2008 - AN ORDINANCE AMENDING <br />CERTAIN SECTIONS OF CHAPTER 15.36 OF THE LOUISVILLE MUNICIPAL <br />CODE, REGARDING HISTORIC PRESERVATION, TO REVISE THE <br />PROCEDURES APPLICABLE TO DEMOLITION REVIEW OF BUILDINGS <br />THAT ARE OVER FIFTY YEARS OLD - 2"d Reading -Public Hearing <br />Mayor Sisk requested a City Attorney introduction. <br />City Attorney Sam Light read Ordinance No. 1538, Series 2008. <br />Mayor Sisk opened the public hearing and requested a Staff presentation. <br />Public Relations Manager Meredyth Muth reported certain provisions in the <br />preservation ordinance regarding demolition reviews do not allow effective or <br />timely review. In December of 200;7, the City Attorney gave a legal opinion that a <br />demolition permit must be completE:d to trigger a demolition review by the <br />Historic Preservation Commission (HPC). A review cannot be done at the <br />
