Lair confirmed the lighting would be budgeted <br />for 2005. <br /> <br />Council member Van Pelt asked Staff to highlight the reductions in the project. City <br />Manager Simmons noted the one-year maintenance contract was removed from the <br />contract and the landscaping was reduced. <br /> <br />MOTION: Council member Brown moved for approval of the Contract with ECI Site <br />Construction Management for the 2004 Skate Park, seconded by Council member <br />Levihn. Roll call vote was taken. The motion passed by a vote of 7-0. <br /> <br />RESOLUTION NO. 34, SERIES 2004 - A RESOLUTION APPROVING THE <br />PURCHASE OF A CERTAIN PARCEL OF LAND TOTALING 3.9 ACRES, <br />MORE OR LESS, AND LOCATED BETWEEN COUNTY ROAD AND <br />ROOSEVELT AVENUE, SOUTH OF THE CITY'S APPROVED COMMUNITY <br />PARK PARCEL, FOR POTENTIAL USE FOR CONSTRUCTION OF TRAILS, <br />COMMUNITY PARK AMENITIES & FACILITIES, AND OTHER <br />GOVERNMENTAL PURPOSES <br /> <br />Mayor Sisk requested a Staff presentation. <br /> <br />Land Management Director Cindy Lair explained in 1999, the City of Louisville and <br />Boulder County purchased 220 acres in fee and 72 acres of conservation easement from <br />Warembourg Colorado Ranches, LLC for open space. In 2004, Staff further negotiated <br />with Boulder County and Warembourg Colorado Ranches to release the conservation <br />easement on 3.9 acres and purchase fee title on the southern border of the future <br />community park to increase the available park and Bella Vista right-of-way acreage from <br />approximately 14 acres to 18 acres. The total price for the transaction will not exceed <br />$132,000. Lair stated the 3.9-acre parcel was approved for a notice of final determination <br />and first reading on July 6, 2004. The representations and warranties in Section 16 of the <br />purchase contract are essentially the same as those used in the 1999 contract with <br />Warembourg Colorado Ranches, LLC for the balance of the property. The funds for this <br />purchase were appropriated from the Conservation Trust-Land Acquisition Fund. The <br />proposed, date for closing on this transaction is September 2, 2004. Upon closing with <br />Warembourg Colorado Ranches, LLC, Boulder County has agreed to release the <br />Conservation Easement. Boulder County is providing a letter to waive its Right of First <br />Refusal, pursuant to the original purchase contract. <br /> <br />Mayor Sisk requested public comment.
