Louisville City Council Meeting <br />September 7, 2004 <br />Page 3 of 12 <br /> <br />Mayor Sisk also addressed the comments expressed relative to the new library, the <br />Louisville Volunteer Fire Department, and the public access cable television channel. He <br />congratulated and thanked all the volunteers for a successful Fall Festival. <br /> <br />REGULAR BUSINESS <br /> <br />DISCUSSION/DIRECTION - DAVID WALDMAN - REQUEST TO AMEND <br /> FABER ANNEXATION AGREEMENT <br /> <br />Mayor Sisk requested a Staff presentation. <br /> <br />Planning Director Paul Wood reviewed that the property owner, Mr. David Waldman, is <br />requesting to amend the underlying Faber Annexation Agreement. The Farber <br />Annexation was annexed to the City in 1985 and zoned to Residential Rural (RR). <br />Section three of the Annexation Agreement stated the subject property "shall not contain <br />more than two residential units, either now or in the future". The Leffingwell residence <br />occupies Lot 2 and the Waldman residence occupies Lot 1, resulting in two residential <br />units. Mr. Waldman is seeking an amendment to the annexation agreement to increase the <br />overall number of dwelling units from two to a total of three. If the Amendment to the <br />Annexation Agreement is authorized, Mr. Waldman will apply for a subdivision replat of <br />Lot 1 into two lots for the purpose of building an additional home. <br /> <br />Wood reviewed the proposed language of the Agreement, which would allow for one <br />additional unit to be located on Lot 1, and would require approval by the City of a <br />subdivision replat and a planned unit development plan in compliance with all City codes <br />and standards. In conjunction with any future subdivision of Lot 1, the owner would <br />grant to the City of Louisville a perpetual and irrevocable deed of conservation easement <br />over the westernmost 1.5 acres. <br /> <br />Wood reviewed the Framework Agreement between the Waldmans and their respective <br />neighbors, the Leffingwells and the Barnes. The agreement sets forth private covenants <br />and restrictions, which pertain to the Waldman property. <br /> <br />Mayor Sisk requested an Applicant presentation. <br /> <br />David Waldman 225 Continental View Drive, Louisville, CO expressed his thanks to the <br />City Council, City Staff and his neighbors for their cooperation. <br /> <br />City Attorney Sam Light outlined the City Council's three options as follows: 1) <br />Approve a motion to take no further action on the requested Amendment. 2) Approve a <br />motion to adopt the proposed Amendment to the Annexation Agreement. 3) Defer action <br />on the proposed Amendment and direct that the proposed Amendment be packaged with <br />an amendment of the Boulder View Subdivision Agreement, a subdivision replat and a <br />PUD request. <br /> <br /> <br />
