Louisville Local Licensing Authority <br />Meeting Date: March 31,2003 <br />Page 4 of 6 <br /> <br />Member Koertje expressed his concern that the licensee did not make any <br />attempts to rectify the situation and made no attempt to contact Ms. Bolte. He <br />continued by stating it shows poor character when an establishment knowingly <br />holds funds not rightfully theirs to begin with. Member Mulvahill echoed his <br />sentiments. <br /> <br />Member Wilson made a motion that sufficient evidence had been presented to <br />support the charges stated in the Notice of Hearing on Application for Renewal. <br />However, the licensee should be given until the Authority meets again on April <br />28, 2003 to make full payment of sales tax due. <br /> <br />The Authority made several comments regarding this. <br /> <br />Chairperson Lipton stated the Authority does not like to make any decisions that <br />would cause the licensee more financial hardship then has already occurred. She <br />continued by saying even though the licensee admits to wrongdoing; she would <br />prefer the matter not be continued until the next Authority meeting. <br /> <br />Member Mulvahill agreed with Chairperson Lipton and was concerned with the <br />licensee's track record over the past year and the fact Mr. Min has done nothing <br />to make the process change. He continued saying there is no reason to believe <br />the licensee will change now. <br /> <br />Member Paige seconded the motion. Roll Call Vote: Lipton-no, Koertje-no, <br />Kimmett-yes, Paige-yes, Wilson-yes. Motion carried 3 to 2. <br /> <br />Chairperson Lipton stated the licensee, Mr. Byung U. Min, d/b/a Little Tokyo, had <br />until the next meeting on April 28, 2003 to show proof State and City tax <br />responsibilities have been met. If the taxes are not paid, the license will not be <br />renewed. <br /> <br />Member Koertje requested Ms. Bolte attend the next Authority meeting to verify <br />whether payment had been received. <br /> <br />Member Kimmett asked the licensee to acknowledge he understood the <br />conditions. Mr. Min replied he understood. <br /> <br />POLICE DEPARTMENT REPORT <br /> <br />A. Incident Report - The Melting Pot (03/14/03) <br /> <br />Detective Lanphere reported the couple in question left before anyone could <br />contact them.
