Louisville Local Licensing Authority <br />Meeting Date: March 31, 2003 <br />Page 3 of 6 <br /> <br />Mr. Byung U. Min, owner of Little Tokyo, represented himself. Mr. Namki Yun, <br />his interpreter, accompanied him. Mr. Min was sworn in. He stated in his <br />opening remarks that he was in financial trouble and intended to pay all sales tax <br />owed. He needed a couple of weeks to bring his payments current. <br /> <br />Mr. Shapiro called his first witness. Ms. Penney Bolte, Sales Tax Coordinator for <br />the City of Louisville, was sworn in. Mr. Shapiro asked Ms. Bolte to explain a <br />sales tax payment history provided to the Authority. Ms. Bolte explained that <br />since the City of Louisville became self-collecting in June of 2002, Little Tokyo <br />has made no payment of sales tax until February 21, 2003. Before June 2002 <br />the State of Colorado collected sales tax. According to the State, one payment <br />had not been received and four other payments were only partial. <br /> <br />Mr. Shapiro asked Ms. Bolte if she had made any effort to contact Mr. Min <br />regarding the delinquency of his account. Ms. Bolte answered she had set up an <br />appointment for Mr. Min and his accountant to come in to her office. Mr. Min did <br />not show up for the meeting and made no attempt to contact Ms. Bolte. <br /> <br />Member Mulvahill asked Ms. Bolte how much money Mr. Min owed in sales tax. <br />Ms. Bolte replied she was not allowed to give out that information because it was <br />confidential. Mr. Min did not have any questions for Ms. Bolte. <br /> <br />Mr. Min then made a statement. He acknowledged he has been delinquent with <br />his sales tax and has set up a payment plan with the State of Colorado. Mr. Min <br />continued, saying he only needed three weeks to get his sales tax current. <br /> <br />Mr. Min provided the Authority with money order receipts which showed <br />payments had been made to the State of Colorado. <br /> <br />Mr. Shapiro then made his closing statement. He reiterated that Little Tokyo <br />knowingly was delinquent on monies not theirs to begin with. Mr. Min was to <br />hold the sales tax collected in trust for the City of Louisville and this was not <br />done. <br /> <br />Mr. Min did not have a closing statement. <br /> <br />Chairperson Lipton then made a motion to go into an executive session solely for <br />the purpose of consulting with the Authority Attorney. All members were in favor. <br />The meeting was suspended at 8:05 p.m. <br /> <br />Regular business items continued.
