Ms. Marcotte said that Mr. <br />Wardrop left around 11:30 p.m. Earlier she had noticed that Mr. Wardrop was <br />staggering, saw him go outside contacted him, as he attempted to get into his car. <br />Ms. Marcotte told him to stop or she would call the police. She then took him back <br />inside and gave him some coffee and called a cab. She got busy and didn't realize <br />that he had left. Ms. Marcotte went outside to look for Mr. Wardrop and saw that <br />his car was still there. Another patron of Gendeman Jim's told her that they had <br />seen someone pick Mr. Wardrop up. At that dme, Officer Steele asked Ms. Marcotte <br />to do a written statement, she agreed. Officer Steele told her not to worry about <br />writing the statement that night. She would contact Ms. Marcotte the next day to <br />pick it up. <br /> <br />Officer Steele then went to Avista Hospital, where Mr. Wardrop was taken, to speak <br />to the doctors and nurses on call that evening. She knew that if Mr. Wardrop didn't <br />have a sober person to be released to he would need to be taken to the Alcohol <br />Recovery Center (ARC). The medical staff was concerned that Mr. Wardrop's <br />alcohol level was too high and that the ARC would not take hind. They called the <br />ARC and determined that it was safe to transport him. Mr. Wardrop was released to <br />Officer Steele, who transported him to the ARC in Boulder. <br /> <br />Once there, Officer Steele asked Mr. Wardrop a few questions. He said that he had <br />been at Gentleman Jim's, then gone to Carraba's for dinner, had a couple of drinks, <br />and then went home and had a few more, and went back Gentleman Jim's. Officer <br />Steele noticed that Mr. Wardrop was wearing slippers and asked him if had gone to <br />the bar wearing slippers. He said yes. Mr. Wardrop said he had about five drinks at <br />Gendeman Jim's. Officer Steele had noticed that Mr. Wardrop's car was parked <br />askew, not in the lines, as all the other cars were parked, which lead Officer Steele to <br />believe that Mr. Wardrop was already drunk when he arrived at Gentleman Jim's. <br /> <br />Jim Hayden, owner of Gentleman Jim's, then questioned Officer Steele. He was <br />concerned about the discrepancy in Mr. Wardrop's behavior between the time the <br />first PBT was taken at the scene and the second, which was taken at the hospital. <br />Mr. Hayden then asked Officer Steele to recount who arrived at the scene and who <br />made the initial call. Officer Steele stated the Fire Departme,nt made the initial call. <br />Mr. Hayden wondered why the Fire Department was out driving around at Midnight. <br />Officer Steele said that the Fire Department had been out on a call. Mr. Hayden <br />then asked if that was when the Fire Department called the Police Department, <br />believing that there was a child down. Mr. Hayden then asked Officer Steele if there <br />were already officers at the scene when she arrived. Officer Steele said that there <br />were two other officers on the scene when she arrived and that is was determined it <br />was not a child but an adult male. Officer Steele said that she didn't make the <br />determinative; it was the first officer to arrive on the scene that made that call. Mr. <br />Hayden asked which officer made the determination. Officer Steele said she believed <br />it had been Officer Watts. Mr. Hayden wanted to know why Officer Watts didn't <br />write the report. Officer Steele said he wrote a supplemental to her report.
