1. The southernmost alley will be maintained by the HOA. <br />2. Satisfy the comments in the Louisville Fire Protection District memo dated <br />February 18, 2016 before recordation. <br />3. Comply with Public Works comments in April 6, 2016 memo before recordation. <br />4. Change the rear setback requirement to 20 feet, with an exception of seven feet <br />allowed for the properties adjacent to the realigned alley. Modify the side setback <br />to state the standard is five feet, except zero may be allowed for buildings that <br />straddle lot lines. <br />5. Limit the number of monument signs to three. <br />6. Add a note to the PUD that the residential buildings will comply with the design <br />standards and guidelines in section 10 of the MUDDSG to the maximum extent <br />practicable. <br />7. That applicant assure that the Truck Only entrance off of Highway 42 is designed <br />so as to permit adequate access for trucks servicing the existing use at 1655 <br />Cannon Circle, Louisville, CO. <br />8. Prior to recording of the plat, the subdivider and City shall enter into an agreement <br />to effect the change in location of the Cannon Circle right-of-way, which shall be in <br />a form acceptable to the City. <br />The applicant has not executed the Final Plat and PUD and submitted to the City for <br />recordation. These approvals expire on May 17, 2019 if not executed and submitted to <br />the City. As noted, the applicant requests several modifications to the approved plan <br />prior to recordation. In working with the applicant to facilitate the changes to the plans, <br />there are still a number of items that the applicant must address to ensure that the plans <br />meet all applicable requirements before recordation. Some of the outstanding items <br />include meeting the conditions of the 2016 City Council approval. Also, with the revisions <br />proposed, staff and the referral agencies identified additional issues which must be <br />addressed prior to recordation. Staff lists all of the outstanding conditions of approval in <br />a subsequent section of this memo. <br />Regarding the conditions of approval as set forth under Resolution No. 24-2016, the <br />following lists the condition and a brief description on how the applicant proposes to <br />address each or ask that the condition be removed. <br />1. The southernmost alley will be maintained by the HOA. <br />The applicant agrees to maintain that portion of the alley that is used for access to <br />the proposed subdivision. However, the applicant requests that the City maintain <br />the remainder of the alley that is not used to access any portion of the proposed <br />subdivision. Staff supports this change in the condition and requests that the limits <br />of maintenance for the City and the HOA be clearly marked on all applicable PUD <br />plans and requests that the applicant agree to pave all of the alley up to Lot 19, <br />Robert D Giacomo Addition.
