ANALYSIS: <br />Compliance with LMC Sec. 17.40.010 — Special Review Uses <br />Section 17.40.010 of the Louisville Municipal Code lists five criteria for SRUs that must <br />be satisfied in order to approve a SRU. Analysis of each criterion is below: <br />1. That the proposed use/development is consistent in all respects with the spirit <br />and intent of the comprehensive plan and of this chapter, and that it would not <br />be contrary to the general welfare and economic prosperity of the city or the <br />immediate neighborhood; <br />The proposed use is consistent in all respects with the Comprehensive Plan and the <br />LMC. The Comprehensive Plan identifies the area as the Fireside Neighborhood, and <br />includes the following applicable principle for all residential neighborhoods: <br />Principle NH-4: The character and identity of existing residential neighborhoods <br />should be maintained while allowing for evolution and development. <br />Staff finds that the proposal for the columbarium design meets this principle by <br />incorporating the use within new exterior walls abutting the existing structure that match <br />the existing architectural design so that the use is not apparent from the street and <br />maintains the existing character of the neighborhood, and allows for the evolution of the <br />uses at the church. Staff finds the proposal meets this criterion. <br />2. That such use/development will lend economic stability, compatible with the <br />character of any surrounding established areas; <br />Staff finds the use will not impact economic stability and is compatible with the character <br />of the surrounding established areas. The architectural design is compatible with the <br />existing church and does not impact character of the surrounding areas. The use is <br />contained with the exterior walls and is not apparent from the street or adjacent <br />properties. Staff finds the proposal meets this criterion. <br />3. That the use/development is adequate for internal efficiency of the proposal, <br />considering the functions of residents, recreation, public access, safety and <br />such factors including storm drainage facilities, sewage and water facilities, <br />grades, dust control and such other factors directly related to public health and <br />convenience; <br />The use will not affect the efficiency or functionality of the site or surrounding area. <br />There are no anticipated impacts related to public access, safety, utilities and other <br />such factors directly related to public health and convenience. Staff finds the <br />proposal meets this criterion. <br />4.
