AUTHORITY ATTORNEY'S REPORT <br /> <br />Provided information requested by Authority member Steve Jeff.ers regarding "Full Cause" requirements <br />on renewal of liquor license application. There was a case in Denver, Colorado, that went to the higher <br />court and the court essentially determined that you could not non-renew a license for cause if you didn't <br />have any standards or criteria which established what cause was. Even on the statute itself it says that <br />you can revoke for good cause and there is prior case law which said it depends on case-by-case <br />determination. You examine the facts of the case and that is how you arrive at good cause. If on the <br />record there is good cause you can do it. The court backtracked without overturning the case. Ross <br />contacted the State Liquor Enforcement Division and talked to them and was told the State Liquor <br />Board is in the process of promulgating new regulations to establish good cause. Once adopted they <br />will be incorporated into the Beer and Liquor Code. <br /> <br />AUTHORITY COMMENTS <br /> <br />Jeffers discussed Lafayette and Steamboat's requirements that all employees must have a Certificate of <br />Training. Lafayette has a sixty (60) day period after the renewal of the license to allow the license <br />holder and their employees to be certified. Steamboat requires that copies of all employee's Certificates <br />of Training be attached to the renewal applications. This has become a nightmare because some training <br />certificates take a few months to receive.
