AUTHORITY BUSINESS <br /> <br />mo <br /> <br />Show Cause Hearing - James R. Hayden, Gentleman Jim's Inc. <br />d/b/a Gentleman Jim's Bar & Grill - Hotel & Restaurant License - 330 S. McCaslin Bivd <br /> <br />Chairperson Jeff.ers called the hearing to order. "This is the hearing to show cause why the liquor license <br />held by Gentleman Jim's, Inc., d/b/a Gentleman Jim's Bar & Grill, should not be suspended or revoked <br />for alleged violations of one or more provisions of the Colorado Liquor Code and Liquor Code <br />Regulations". <br /> <br />"The purpose of the hearing is to receive evidence to enable the authority to make findings and reach a <br />conclusion as to whether there is sufficient evidence proving the Licensee violated one or more of the <br />laws and regulations specified in the Show Cause Order, and if so, whether revocation or suspension of <br />the Licensee's license is appropriate". <br /> <br />"Would the attorneys for the City and Licensee please identify themselves and state whether they are <br />ready to proceed". "Does either party have any preliminary matters to be taken care of at this time"? <br /> <br />Chairperson Jeff.ers asked if there were any authority members who might have a conflict of interest with <br />this particular case? <br /> <br />Kimmett disclosed that the attorney for Gentleman Jim's was personally known to him and asked to be <br />excused from the proceedings. Granted by the Authority. <br /> <br />Special Prosecutor for the City, Steve Barnett and Mr. Leonardo Berenato, Attorney for the Licensee, <br />presented to the Authority the terms of a proposed stipulation. The terms of said stipulation were as <br />follows: <br /> <br />Paragraph A.) of the Show Cause Order, which dealt with the service of alcoholic beverages <br />to persons under age, would be admitted to by the licensee. <br /> <br />2.) <br /> <br />The matters referred to in paragraph B.) and C.), both of which dealt with the provision of <br />alcoholic beverages to visibly intoxicated persons, would be dismissed. <br /> <br />3.) <br /> <br />The licensee would be suspended for a period of five (5) days as a penalty for violation of <br />Colorado Liquor Code and Regulations, as set forth in paragraph A.) of the Order. Three (3) <br />days suspension would be served and two (2) days held in abeyance for a period of twelve (12) <br />months, pending no further violations of the liquor codes and regulations, during that period.
