There was discussion relative to the lease for Barr's Restaurant. The lease for the building must cover <br />the renewal year of license, i!~urrently, the lease for Bart's Restaurant expires November 1, 1999 and the <br />liquor license, if renewed, would expire November 28, 1999. Approval of the renewal application would <br />be contingent upon receipt of a new lease, covering the entire term of the liquor license. <br /> <br />There was also discussion with regards to the renewal application for the Firegrill Restaurant. Authority <br />members asked for clarification on the statute which governs whether a liquor license could be renewed <br />without the construction of a building. <br /> <br />Authority Attorney Sam Light stated that according to the statute, the Authority has two choices relative <br />to the matter. The Authority can revoke or choose not issue a renewal license if the facility has not <br />commenced construction within one year of approval of the initial license. They were granted their <br />license on October 27, 1997, so that option is not available to the Authority at this time. The other <br />option is the Authority can choose not to renew if the facility has not been constructed and occupied <br />within two years. Therefore, the Firegrill liquor license is not at either point yet. <br /> <br />Attorney Light noted that the renewal for the Firegrill Restaurant had been filed late. Under CRS 12-47- <br />302, a renewal application must be filed at least 45 days prior to expiration. The Authority, through <br />motion, may waive this requirement. <br /> <br />AUTHORrrY BUSINESS <br /> <br />Show Cause Hearing - Stipulation, Agreement, and Order - S.T. Thede, Ltd., d/b/a Pine <br />Street Junction - Hotel & Restaurant License - 1009 Pine Street. <br /> <br />Attorney Light reviewed the proposed Stipulation and Agreement and Order for the Pine Street Junction. <br />Originals were sent to Sara Talbert and signed by her. Under the proposal the license would be <br />suspended for four days, one day of the four day suspension would be served on Sunday, September 27, <br />1998. The remaining three days would be held in abeyance, pending no further violations in the next <br />twelve months. <br /> <br />The licensee is currently a Corporation and is in the process of transferring the stock ownership in the <br />corporation. If the Stipulation and Agreement is approved, it will be entered into the file for the <br />corporation, so that any future violation will count against the corporate licensee. Attorney Light advised <br />the Authority that they might consider the fact that there has been a change in shareholders when passing <br />on a future violation, but the Stipulation and Agreement would be binding. <br /> <br />2 <br /> <br /> <br />
