the deceased had a blood alcohol level content of 0.278, which Sergeant Riggins explained was almost
three times the legal limit of the state of intoxication.

The Authority voiced their concern that one or more violations of the Colorado Beer and Alcohol Code
have been violated. It was the general consensus that there was probably cause regarding violations of
serving visibly or apparently intoxicated persons, including potentially a habitual drunkard. A Notice of a
Show Cause Hearing should be set.

SECRETARY'S REPORT

The Secretary reported that three employees of the American Legion attended Liquor Training Classes on
November 3, 1996, and three employee attended training on April 6, 1997.

Louisville/Lafayette joint liquor training classes are tentatively scheduled, to be held in Louisville on
Sunday, October 25, 1998 from 10:00 to 11:30 a.m., and Tuesday, October 27, 1998 from 5:00 to 6:30
p.m. Notice of these dates, when confirmed, will be sent to all liquor licensed establishment in Louisville.

ATTORNEY'S REPORT

Attorney Light noted that in review of late filings of liquor license renewals, the statute provides that the
Authority may for good cause waive the forty-five day requirement. He asked if the Authority would like
the Attorney's office to review state and other municipalities rules and amend the bylaws or City code
relative to what is good cause for waiving the 45 day requirement. It was Light's concern that some
licensees were becoming lax in filing ?enewal applications in a timely fashion. CRS 12-47-302 provides
that late renewal application can be assessed a $500.00 late fee for the City and a duplicate $500.00 fee
for the State. Light stated that the Authority has the option to assess the late fees if the trend to file late
renewal applications continues.

AUTHORITY COMMENTS

Chairperson Jeffers reported that he had lef~ a phone message for Authority Member Gene Morris.
Morris had returned the call, but Jeffers was not available. Jeffers will attempt to contact Morris again.

4
