Planning Commission <br />Meeting Minutes <br />April 10, 2008 <br />Page 11 of 13 <br />2) The HWY 42 Revitalization Study resulted in the adoption of the HWY 42 <br />Framework Plan in 2003. The focus of the Framework Plan was to construct a <br />`Preferred Land Use Plan' which would be a guide to subsequent development in <br />the study area. The proposed rezoning request I consistent with a series of <br />Planning Goals and Polices in the 2005 Citywide Comprehensive Plan. <br />3) It is the position of staff that the proposed zoning of MU-R is fully consistent with <br />the provision of Chapter 17.14 (Mixed Use Zone District) which was recently <br />incorporated in to the LMC. <br />4) Staff does not find that this criterion is applicable. <br />Staff recommends approval of Resolution No. 08, Series 2008 which is a request of <br />rezoning to MU-R based on the findings that the request is consistent with the <br />Comprehensive Plan as well as the provisions of the Mixed U 'esidential Zone <br />District. <br />Commission Questions: <br />Tengler and Wood discussed Criteria #1 for clarification. <br />Applicant Presentation: <br />Kent Bagley, 90 Madison St., Suite 300, Denver, CO representing the applicant <br />Aggregate Industries introduced Matt Hall from Aggregate <br />Matt Hall, Parker, CO provided a brief history of the property ownership. He discussed <br />the desire of Aggregate to make the property a best of use of real estate for the <br />company. Aggregate has been talking with RTD regarding potential uses of the site <br />based on the Revitalization tudy Area. <br />Bagley continued with the following discussion points: <br />. The subject property represents approximately 20% of the Revitalization <br />Area. <br />. The proposed commuter rail is an important component of the rezoning and <br />the discussions that the company has been having with RTD regarding the <br />future uses for the property. <br />• Aggregate Industry is not a developer but the will work with a yet <br />undetermined developer for the site development. <br />Bagley summarized what Aggregate views as the benefits for the City of Louisville, <br />Aggregate Industries and RTD <br />Members of the Public: None heard. <br />Commission Questions: <br />Sheets asked if a developer had been selected. <br />Bagley stated one had not been selected but a few have expressed interest. <br />Lipton inquired if it is necessary to have an environmental study done on the property. <br />Hill stated a Phase I had already been completed. <br />Staff and Applicant Summary and Recommendation: None heard. <br />Public Hearing Closed Commission Comments: <br />All Commissioners that were present indicated they had no comments. <br />
