(Continued from <br />March 20, 2008.) <br />• Applicant and Owner: Aggregate Industries (Michael Refer) <br />Representative: Bagley Development Consultants (Kent Bagley) <br />Case Manager: Paul Wood, Planning Director <br />Public Notice: <br />Hearing was continued from a previous meeting date of March 20, 2008. Therefore, a <br />new notice was not required. Staff noted the mailing area for the public notice was <br />expanded from the required 500' area to 1500'. Also, the property was posted with a <br />sign. <br />Conflict of Interest and Disclosure: None heard. <br />Staff Report of Facts and Issues: <br />Wood cussed the following: <br />A request for approval of Resolution No. 08, Series 2008 approving a request <br />to rezone the subject parcel from City of Louisville Industrial (I) to City of <br />Louisville Mixed Use Residential (MU-R). <br />ect property is located adjacent to and on the east side of the BNSF <br />Railroad right-of-way, on Short Street and known as 1125 Short Street. <br />▪ The property is approximately 4.9 acres in area. <br />Property is currently occupied by a concrete batch plant and associated <br />building structures. <br />• The rezoning request is a voluntary request. <br />Wood stated the request was reviewed for compliance with the LMC Section 17.44.050 <br />which is the rezone criteria. Following is a summary of the findings supporting each of <br />the criteria. <br />1) The subject parcel was not zoned in error, but as presently zoned is no longer <br />consistent with the City's Comprehensive Plan. <br />
